{"data":{"id":"us-ky/krs-312.152","jurisdiction":"us-ky","citation":"KRS 312.152","heading":"Witnesses under subpoena.","body":"(1) Subpoenas for witnesses, whose evidence is deemed material to an investigation or\nhearing authorized by KRS 312.150 and this section, may be issued by the board or\nany officer of the board and under the seal of the board, commanding the witness to\nappear b efore the board at a time and place to be named, and to bring books,\nrecords, and documents that may be specified, or to submit books, records, and\ndocuments for inspection. Subpoenas may be served by any sheriff or deputy.\n(2) When any witness who has been served with a subpoena fails or refuses to appear at\nthe time and place named; or fails or refuses to answer any lawful question\npropounded; or fails to produce the books, records, or documents required; or is\nguilty of disorderly or contumacious conduct  at the hearing, the board may invoke\nthe aid of the Franklin Circuit Court and any order or subpoena of the court\nrequiring the attendance and testimony of witnesses and the production of\ndocumentary evidence may be enforced and shall be valid anywhere in the state.\n(3) Witnesses shall be entitled to the same fees and mileage as they may be entitled to\nby law for attending as witnesses in a Circuit Court.\n(4) Witnesses who testify under subpoena shall be entitled to the same protection and\nimmunities as witnesses in judicial proceedings.","path":["KRS Chapter 312"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30791","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:09Z","sha256":"a9a791c6f961f874585d4540bbb8a8fa7af65a4afcb1b56240fc0e691a86aa91","source_id":"us-ky","stale":false,"prev":"us-ky/krs-312.150","next":"us-ky/krs-312.155"},"notice":"GroundRules: Original legal text.
