{"data":{"id":"us-ky/krs-312.220","jurisdiction":"us-ky","citation":"KRS 312.220","heading":"Duty of treating chiropractor utilizing telehealth to ensure patient's","body":"informed consent and maintain confidentiality -- Board to promulgate\nadministrative regulations -- Definition of \"telehealth\".\n(1) A treating chiropractor who provides or facilitates the use of telehealth shall ensure:\n(a) That the informed consent of the patient, or another appropriate person with\nauthority to make the health care treatment decision for the patient, is obtained\nbefore services are provided through telehealth; and\n(b) That the confidentiality of the patient's medical information is maintained as\nrequired by this chapter and other applicable law. At a minimum,\nconfidentiality shall be maintained through appropriate processes, practices,\nand technology as designated by  the board and that conform to applicable\nfederal law.\n(2) The board shall promulgate administrative regulations in accordance with KRS\nChapter 13A to implement this section and as necessary to:\n(a) Prevent abuse and fraud through the use of telehealth services;\n(b) Prevent fee-splitting through the use of telehealth services; and\n(c) Utilize telehealth in the provision of chiropractic services and in the provision\nof continuing education.\n(3) For purposes of this section, \"telehealth\" means the use of inte ractive audio, video,\nor other electronic media to deliver health care.
