{"data":{"id":"us-ky/krs-313.010","jurisdiction":"us-ky","citation":"KRS 313.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context requires otherwise:\n(1) \"Board\" means the Kentucky Board of Dentistry;\n(2) \"Certified dental technician\" means an individual recognized as such by the\nNational Board for Certification in Dental Laboratory Technology;\n(3) \"Delegated duties list\" means the list of procedures authorized in administrative\nregulation which may be delegated by a dentist licensed under this chapter to a\nlicensed dental hygienist or a registered dental assistant;\n(4) \"Dental auxiliary personnel\" means any staff member of a dental office not licensed\nby or registered with the board;\n(5) \"Dental hygiene\" means the treatment of the oral cavity, including but not limited to\ndental hygiene assessment or screening, scaling and root planing, nons urgical\ntherapy, removing calcareous deposits, removing accumulated accretion from\nbeneath the free gingival margin, cavity preventive procedures, and periodontal\nprocedures that require administering antimicrobial agents along with other general\ndentistry activities outlined in the treatment care plan and not prohibited by this\nchapter or by administrative regulation promulgated by the board;\n(6) \"Dental hygienist\" means any person who is licensed to practice dental hygiene\nunder this chapter;\n(7) \"Dental laboratory\" includes any person, firm, or corporation other than a licensed\ndentist, who directly or through an agent or employee, by any means or method, in\nany way supplies or manufactures artificial substitutes for the natural teeth, other\nthan those un finished substitutes normally available through dental supply houses,\nor who furnishes supplies, constructs, or reproduces or repairs any prosthetic\ndenture, bridge, or appliance to be worn in the human mouth, or who performs or\noffers or undertakes to perform or accomplish dental laboratory technology;\n(8) \"Dental laboratory technician\" means any person who performs or offers or\nundertakes to perform or accomplish dental laboratory technology;\n(9) \"Dental specialist\" means a dentist who is licensed to prac tice in a dental specialty\nfield under this chapter;\n(10) \"Dentist\" means any person who is licensed to practice dentistry under this chapter;\n(11) (a) \"Dentistry\" means the evaluation, diagnosis, prevention, or surgical,\nnonsurgical, or related treatment of diseases, disorders, or conditions of the\noral cavity, maxillofacial area, or the adjacent and associated structures and\ntheir impact on the human bo dy provided by a dentist within the scope of his\nor her education, training, and experience and in accordance with the ethics of\nthe profession and applicable law.\n(b) Any person shall be regarded as \"practicing dentistry\" who, for a fee, salary,\nor other reward paid, or to be paid either to himself or herself or to another\nperson:\n1. Performs or advertises to perform, dental operations of any kind,\nincluding the whitening of natural or manufactured teeth;\n2. Diagnoses or treats diseases or lesions of huma n teeth or jaws, or\nattempts to correct malpositions thereof;\n3. Diagnoses or treats disorders, or deficiencies of the oral cavity and\nadjacent associated structures;\n4. Takes impressions of the human teeth or jaws to be used directly in the\nfabrication of any intraoral appliance;\n5. Constructs, supplies, reproduces, or repairs any prosthetic denture,\nbridge, artificial restoration, appliance or other structure to be used or\nworn as a substitute for natural teeth, except upon the written laboratory\nprocedure work order of a licensed dentist and constructed upon or by\nthe use of casts or models made from an impression taken by a licensed\ndentist;\n6. Advertises, offers, sells, or delivers any such substitute or the services\nrendered in the construction, reprod uction, supply, or repair thereof to\nany person other than a licensed dentist;\n7. Places or adjusts such substitute in the oral cavity of another; and\n8. Uses the words \"dentist,\" \"dental surgeon,\" the letters \"D.D.S.,\"\n\"D.M.D.,\" or other letters or title in connection with his or her name,\nwhich in any way represents him or her as being engaged in the practice\nof dentistry;\n(12) \"Direct supervision\" means that the dentist is physically present in the dental office\nor treatment facility, personally diagnoses the condition to be treated, authorizes the\nprocedures to be performed, remains in the dental office or treatment facility while\nthe procedures are being performed, and evaluates the performance of the\nindividual supervised;\n(13) \"General supervision\" me ans a circumstance of treatment in which a dentist\nlicensed under this chapter must diagnose and authorize the work to be performed\non a patient by the dental hygienist authorized pursuant to administrative regulation\nto work under general supervision but the dentist is not required to be on the\npremises while the treatment is carried out;\n(14) \"Registered dental assistant\" means any person who is registered with the board and\nworks under the direct supervision of a dentist;\n(15) \"Telehealth\" means the use of interactive audio, video, or other electronic media to\ndeliver health care. It includes the use of electronic media for diagnosis,\nconsultation, treatment, transfer of health or medical data, and continuing\neducation; and\n(16) \"Volunteer community healt h setting\" means a setting in which services are\nrendered at no charge to the patient or to third-party payors.","path":["KRS Chapter 313"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56872","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:09Z","sha256":"5c7b04138461512f40f158085bcf36f91d9c4ade014d60ad872e7b7eba038f96","source_id":"us-ky","stale":false,"prev":"us-ky/krs-313.001","next":"us-ky/krs-313.020"},"notice":"GroundRules: Original legal text.
