{"data":{"id":"us-ky/krs-313.020","jurisdiction":"us-ky","citation":"KRS 313.020","heading":"Kentucky Board of Dentistry -- Members -- Qualifications -- Terms --","body":"Meetings -- Quorum -- Vacancies -- Compensation -- Annual reports.\n(1) The Kentucky Board of Dentistry shall consist of ten (10) voting members, each\nappointed by the Governor t o a four (4) year term, and additional nonvoting ex\nofficio members selected by their respective organizations as follows:\n(a) Seven (7) voting members of the board shall be licensed dentists, at least three\n(3) of whom shall be general dentists. Each shal l be appointed from a list of\nthree (3) names recommended for each board position by the resident licensed\ndentists of Kentucky at an annual election at a time selected by the Kentucky\nBoard of Dentistry;\n(b) Two (2) voting members of the board shall be de ntal hygienists licensed to\npractice dental hygiene in the Commonwealth. Each shall be from a list of\nthree (3) names recommended for this position by the resident licensed dental\nhygienists of Kentucky at an annual election at a time selected by the board;\n(c) One (1) voting member shall be a citizen at large who is not associated with\nor financially interested in the practice or business regulated;\n(d) One (1) nonvoting ex officio representative from each dental school program\nin Kentucky that is accredit ed by the Commission on Dental Accreditation\n(CODA) shall represent the dental schools' interests;\n(e) Two (2) nonvoting ex officio representatives from the dental hygiene degree\nprograms in Kentucky that are accredited by CODA and that are not\nassociated with a dental school shall represent the dental hygiene programs'\ninterests. The dental hygiene school seats shall rotate on a staggered, biennial\nbasis; and\n(f) One (1) nonvoting ex officio representative from the Department for Public\nHealth shall represent the department's interests.\n(2) Individuals seeking board appointment as a voting member, other than the citizen\nmember, shall have been an actual resident and a licensed practicing dentist or\ndental hygienist of the Commonwealth for not less than five  (5) years immediately\npreceding his or her appointment to the board, be in good standing with the board,\nand shall not have been disciplined by the board in the past eight (8) years. A voting\nmember shall not receive compensation from or have a financial interest in any\ndental college or dental department of any institution of learning, dental supply\nbusiness, or any entity over which the board has regulatory authority or for which it\nsets standards. For this subsection alone, a private admonishment shall not count as\ndiscipline.\n(3) A board member shall not serve more than two (2) consecutive terms. A member\nappointed to a partial term vacancy exceeding two (2) years shall be deemed to\nhave served one (1) full term. A former member may be reappointed follo wing an\nabsence of one (1) term.\n(4) The board shall annually:\n(a) Meet at least four (4) times a year;\n(b) At the first meeting of the board after July 1, elect officers of the board by\nmajority vote of the members present; and\n(c) Set a schedule of at least four (4) regular meetings for the next twelve (12)\nmonth period.\n(5) A majority of the voting members of  the board shall constitute a quorum for the\ntransaction of business.\n(6) (a) A member of the board who misses three (3) regular meetings in one (1) year\nshall be deemed to have resigned from the board, and his or her position shall\nbe deemed vacant.\n(b) The failure of a board member to attend a special or emergency meeting shall\nnot result in any penalty.\n(c) The year specified in paragraph (a) of this subsection shall begin with the first\nmeeting missed and end three hundred sixty -five (365) days later or  with the\nthird meeting missed, whichever occurs earlier.\n(d) The Governor shall appoint a person of the same class to fill the vacancy\nwithin ninety (90) days.\n(e) A person removed under this subsection shall not be reappointed to the board\nfor four (4) years.\n(7) Each voting member of the board shall receive any necessary expenses incurred in\nattending its meetings. Each voting member shall receive as compensation two\nhundred dollars ($200) for each day actually engaged in the duties of his or her\noffice.\n(8) Annual reports and recommendations from the board shall be sent by February 1\neach year to the Governor and the General Assembly.","path":["KRS Chapter 313"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56873","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:09Z","sha256":"fa9eb19f6359f440321dc58718f8dd02074cae82508beb71c590cb3757a08584","source_id":"us-ky","stale":false,"prev":"us-ky/krs-313.010","next":"us-ky/krs-313.021"},"notice":"GroundRules: Original legal text.
