{"data":{"id":"us-ky/krs-313.021","jurisdiction":"us-ky","citation":"KRS 313.021","heading":"Functions and duties of board -- Authority for administrative regulations -","body":"- Employees -- Biennial budget -- Liability insurance.\n(1) The board shall:\n(a) Exercise all of the administrative functions of the Commonwealth in the\nregulation of the p rofession of dentistry, including but not limited to dentists,\ndental hygienists, dental assistants, and dental laboratories;\n(b) Subject to the provisions of this chapter, create levels of licensure or\nregistration as appropriate for individuals providing  services under this\nchapter. These shall consist of:\n1. Dentist;\n2. Dental hygienist; and\n3. Dental assistant;\n(c) Promulgate administrative regulations in accordance with KRS Chapter 13A\nfor any license or registration the board may create. The administr ative\nregulations shall, at a minimum, address:\n1. Requirements for students, if appropriate;\n2. Requirements for education;\n3. Eligibility for licensure or registration; and\n4. Renewal requirements;\n(d) Oversee the operations and establish the organizational structure of the Office\nof the Kentucky Board of Dentistry, which is created and shall be attached to\nthe board for administrative purposes. The office shall be headed by the\nexecutive director appoin ted under paragraph (e) of this subsection and shall\nbe responsible for:\n1. Personnel and budget matters affecting the board;\n2. Fiscal activities of the board, including grant writing and disbursement\nof funds;\n3. Information technology, including the des ign and maintenance of\ndatabases;\n4. Licensure of dentists and dental hygienists;\n5. Registration of dental assistants;\n6. Investigation of complaints; and\n7. Other responsibilities which may be assigned to the executive director\nby the board;\n(e) Employ an executive director and fix his or her compensation. The executive\ndirector shall serve at the pleasure of the board, administer the day -to-day\noperations of the Office of the Kentucky Board of Dentistry, and supervise all\ndirectives of the board. The exe cutive director shall possess a baccalaureate\ndegree and shall have no less than five (5) years of experience in public\nadministration;\n(f) Employ or contract with an attorney licensed to practice law in Kentucky and\nfix his or her compensation. The attorn ey shall serve at the pleasure of the\nboard and have primary assignment to the board;\n(g) Employ or contract with personnel sufficient to carry out the statutory\nresponsibilities of the board;\n(h) Establish committees and subcommittees and the membership t hereof.\nMembers of committees and subcommittees shall not need to be members of\nthe board;\n(i) Provide for affiliation with the American Association of Dental Boards and all\ntesting organizations that administer qualifying examinations for licensure\nrequired under this chapter;\n(j) Select the subject matter and standards of proficiency for examinations related\nto issuance of licenses or registrations issued under this chapter or\nadministrative regulations promulgated hereunder; and\n(k) Have the authority to  issue advisory opinions and declaratory rulings related\nto this chapter and the administrative regulations promulgated thereunder as\nestablished by administrative regulation.\n(2) The board may utilize materials, services, or facilities as may be made avai lable to\nit by other state agencies or may contract for materials, services, or facilities.\n(3) The board shall develop a proposed biennial budget for all administrative and\noperational functions and duties.\n(4) The board shall purchase liability insurance  for board and staff members against\nacts performed in the good faith discharge of duties.","path":["KRS Chapter 313"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56874","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:09Z","sha256":"e22b440f001d907ac504b613fc1023295d4d5c4e5c7318c0738e025ce51585b4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-313.020","next":"us-ky/krs-313.022"},"notice":"GroundRules: Original legal text.
