{"data":{"id":"us-ky/krs-313.070","jurisdiction":"us-ky","citation":"KRS 313.070","heading":"Persons not licensed or registered -- Prohibitions on practicing -- Penalties","body":"-- Disciplinary powers of board -- Exceptions -- Hearing in Circuit Court.\n(1) A person who is not licensed or registered, or whose license or registration has been\nsuspended, revoked, or denied, shall not practice as a dentist, dental hygienist, or\ndental assistant.\n(2) Any person who violates subsection (1) of this section is guilty of a Class B\nmisdemeanor for the first offense and a Class A misdemeanor for each subse quent\noffense.\n(3) The provisions of this section shall not preclude the board from revoking or\nincreasing the suspension period of a person practicing as a dentist, dental\nhygienist, or dental assistant who has illegally practiced while his or her license  or\nregistration is under suspension or has been revoked.\n(4) The filing of criminal charges or a criminal conviction for violation of the\nprovisions of this chapter or the administrative regulations promulgated by the\nboard in accordance with KRS Chapter 13A shall not preclude the board from\ninstituting or imposing board disciplinary action authorized by this chapter against\nany person or organization violating this chapter or the administrative regulations\npromulgated by the board in accordance with KRS Chapter 13A.\n(5) The institution or imposition of disciplinary action by the board against any person\nor organization violating the provisions of this chapter or the administrative\nregulations promulgated by the board in accordance with KRS Chapter 13A shal l\nnot preclude the filing of criminal charges against or a criminal conviction of any\nperson or organization for violation of the provisions of this chapter or the\nadministrative regulations promulgated by the board in accordance with KRS\nChapter 13A.\n(6) (a) This chapter shall not prohibit students from performing dental operations\nunder the supervision of competent instructors approved by the dental school,\ncollege, or department of a university. The board may authorize the students\nof any dental college,  school, or department of a university to practice\ndentistry in any state or municipal institution or public school, or under the\nboard of health, or in a public clinic or a charitable institution. A fee shall not\nbe accepted by the student beyond the expenses provided by the stipend.\n(b) Students shall be at all times under the direct supervision of a dentist licensed\nin this state who is an instructor of the institution at which they are studying.\n(7) This chapter shall not prohibit volunteer health pract itioners providing services\nunder KRS 39A.350 to 39A.366.\n(8) Violations of this chapter shall be heard in the Circuit Court of the county in which\nthe alleged offense occurred.","path":["KRS Chapter 313"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56882","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:09Z","sha256":"cb70e3a650f6c6d7f56d686047ace9660d3aeea9ebcf53aadd31c956c5d2175d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-313.060","next":"us-ky/krs-313.075"},"notice":"GroundRules: Original legal text.
