{"data":{"id":"us-ky/krs-313.075","jurisdiction":"us-ky","citation":"KRS 313.075","heading":"Prohibitions on actions related to dentistry without a license -- Clinical","body":"operations of dental practice prohibited from establishing reimbursement\nrates of services -- Prospective application of section.\n(1) A person or entity shall not:\n(a) Represent themselves by using the title dentist, dental specialist, dental\nhygienist, or dental assistant unless licensed or registered under the provisions\nof this chapter;\n(b) Own, operate, offer to operate, or represent or advertise the operation of a\ndental practice of any type unless licensed by or employing individuals\nlicensed by the board; or\n(c) Employ a dentist, dental hygienist, or dental assistant unless that dentist,\ndental hygienist, or dental assistant is licensed or registered under the\nprovisions of this chapter.\n(2) In a clinical setting:\n(a) A person or entity that is not licensed to practice dentistry under this chapter\nshall not exercise control over:\n1. Clinical decision making;\n2. Diagnosis or treatment planning;\n3. Patient records;\n4. The supervision of licensed dental personnel; or\n5. The professional judgment of a licensed dentist; and\n(b) A licensed dentist shall retain final authority and responsibility for all clinical\ndecisions affecting patient care.\n(3) The clinical operations of a dental practice entity shall not be directly or indirectly\ncontrolled by a person or entity that establishes reimbursement rates for dental\nservices.\n(4) This section shall apply prospectively and ownership interests or contractual\narrangements lawfully in existence on April 13, 2026, shall not be:\n(a) Impaired or invalidated; or\n(b) Prohibited from future expansion or modification.","path":["KRS Chapter 313"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56883","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:09Z","sha256":"59f82a212614c77f93cbe18881a1d1a1fff7c7fa3407ca5df427ed344ebf05a1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-313.070","next":"us-ky/krs-313.080"},"notice":"GroundRules: Original legal text.
