{"data":{"id":"us-ky/krs-313.080","jurisdiction":"us-ky","citation":"KRS 313.080","heading":"Grounds for discipline or for revocation or suspension of license or","body":"registration -- Criminal prosecution.\n(1) A person or entity shall not maintain any license or certificate authorized by this\nchapter if convicted of, having entered a guilty plea to, having entered an Alford\nplea to, or having completed a diversion program for a Class A, B, or C felony\noffense on or after the date of initial licensure or registration.\n(2) Persons licensed or registered by the board or who are applicants for li censure or\nregistration by the board shall be subject to disciplinary action by the board if they:\n(a) While licensed or registered by the board:\n1. Violate:\na. Any provision of this chapter or any administrative regulation\npromulgated by the board; or\nb. KRS 304.39-215; or\n2. Engage in conduct that is subject to the penalties under KRS 304.99 -\n060(4) or (5);\n(b) Use fraud or deceit in obtaining or attempting to obtain a license or\nregistration from the board, or are granted a license upon mistake of a material\nfact;\n(c) While licensed or registered by the board, act in a manner inconsis tent with\nthe moral or ethical standards of the discipline for which the person is\nlicensed or registered;\n(d) Are unable to practice a discipline regulated by the board with reasonable skill\nor safety or are unfit or incompetent to practice a discipline r egulated by the\nboard;\n(e) Abuse, misuse, or misappropriate any drugs placed in the custody of the\nlicensee or certified person for administration, or for use of others, or those\ndrugs prescribed by the licensee;\n(f) Falsify or fail to make essential entries on essential records;\n(g) Are convicted of a misdemeanor which involved acts which bear directly on\nthe qualifications or ability of the applicant, licensee, or certified person to\npractice the discipline for which the person is an applicant, licensee, or\ncertified person, if in accordance with KRS Chapter 335B;\n(h) Are convicted of a misdemeanor which involved fraud, deceit, breach of trust,\nor physical harm or endangerment to self or others, acts which bear directly\non the qualifications or ability of the applicant, licensee, or certificate holder\nto practice acts in the license or registration held or sought, if in accordance\nwith KRS Chapter 335B;\n(i) Are convicted of a misdemeanor offense under KRS Chapter 510 involving a\npatient;\n(j) Have had a lice nse or certificate to practice as a dentist, dental hygienist, or\ndental assistant denied, limited, suspended, probated, revoked, or otherwise\ndisciplined in Kentucky or in another jurisdiction on grounds sufficient to\ncause a license to be denied, limited , suspended, probated, revoked, or\notherwise disciplined in this Commonwealth;\n(k) Have a license or registration to practice any activity regulated by the board\ndenied, limited, suspended, probated, revoked, or otherwise disciplined in\nanother jurisdiction on grounds sufficient to cause a license or registration to\nbe denied, limited, suspended, probated, revoked, or otherwise disciplined in\nthis Commonwealth;\n(l) Violate any lawful order or directive previously entered by the board;\n(m) Have been listed o n the National Practitioner Databank with a substantiated\nfinding of abuse, neglect, or misappropriation of property;\n(n) Fail to notify the board in writing of any change in the person's name,\nresidential address, employment address, preferred mailing add ress, or\ntelephone number within thirty (30) days of the change;\n(o) Fail to comply with KRS 422.317 regarding patient records; or\n(p) Fail to report to the board any negative outcome related to dental treatment\ninvolving intravenous or conscious sedation beyond anxiety control that\nrequires hospital admission.\n(3) A person who violates subsection (1) of this section shall be guilty of a Class B\nmisdemeanor for a first offense and a Class A misdemeanor for each subsequent\noffense. The board shall consider e ach individual count of a violation as a separate\nand subsequent offense.\n(4) The provisions of this section shall not preclude prosecution for the unlawful\npractice of dentistry by an agency of the Commonwealth.\n(5) The filing of criminal charges or a cri minal conviction for violation of the\nprovisions of this chapter or the administrative regulations promulgated by the\nboard in accordance with KRS Chapter 13A shall not preclude the Office of the\nBoard from instituting or imposing board disciplinary action  authorized by this\nchapter against any person or organization violating this chapter or the\nadministrative regulations promulgated by the board in accordance with KRS\nChapter 13A.\n(6) The institution or imposition of disciplinary action by the Office of t he Board\nagainst any person or organization violating the provisions of this chapter or the\nadministrative regulations promulgated thereunder shall not preclude the filing of\ncriminal charges against or a criminal conviction of any person or organization f or\nviolation of the provisions of this chapter or the administrative regulations\npromulgated by the board in accordance with KRS Chapter 13A.","path":["KRS Chapter 313"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56884","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:09Z","sha256":"9dfe3792b080716d8b0f62b51c70e1847d2c4369f54de10684e22b7c6f4ad4de","source_id":"us-ky","stale":false,"prev":"us-ky/krs-313.075","next":"us-ky/krs-313.085"},"notice":"GroundRules: Original legal text.
