{"data":{"id":"us-ky/krs-313.085","jurisdiction":"us-ky","citation":"KRS 313.085","heading":"Law Enforcement Committee -- Emergency order for suspension of license","body":"or certificate -- Appeals.\n(1) The Law Enforcement Committee shall consist of three (3) members of the board,\nincluding at least two (2) licensed dentists, appointed by the president of the board.\n(2) The Law Enforcement Committee may, by a majority vote, issue an emergency\norder for the immediate temporary suspension of a license or certificate against\nwhich disciplinary action or an investigation is pending if the order is necessa ry to\nprotect the public.\n(3) The emergency order shall be made in accordance with KRS 13B.125 and shall be\nbased upon a finding by the board that the emergency order is in the public interest\nand there is substantial evidence of immediate danger to the he alth, welfare, and\nsafety of any patient or the general public.\n(4) A licensee may appeal the emergency order by a written request to the board for an\nemergency hearing in accordance with KRS 13B.125 within thirty (30) days after\nreceipt of the order.\n(5) The appeal of an emergency order shall address only the necessity for the action and\nshall not constitute an appeal of the merits of the underlying complaint or charge.\n(6) The emergency order shall remain in effect until modified or vacated by the Law\nEnforcement Committee or hearing officer or superseded by final disciplinary\naction of the Law Enforcement Committee or hearing officer on the underlying\ncomplaint or charge.\n(7) The Law Enforcement Committee shall expedite disciplinary hearings in which a\nlicense has been suspended under subsection (2) of this section.\n(8) Any party aggrieved by a final order of the board may appeal the final order to the\nCircuit Court of the county in which the licensee or certificate holder resides after a\nwritten decision is rendered.","path":["KRS Chapter 313"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30818","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:09Z","sha256":"70f98b0f47147ba649deb62e991ae01af1c7d1a12cf74fad4c61d5a88ef9a4a7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-313.080","next":"us-ky/krs-313.090"},"notice":"GroundRules: Original legal text.
