{"data":{"id":"us-ky/krs-313.254","jurisdiction":"us-ky","citation":"KRS 313.254","heading":"Temporary license for dentist or dental hygienist to provide medical care","body":"to indigent populations -- Waiver for volunteers.\n(1) The board may grant a temporary license to a dentist or dental hygienist who holds a\ncurrently valid license from another s tate, district, possession, or territory of the\nUnited States for the sole purpose of providing medical care to indigent populations\nwho may not otherwise be able to obtain such services, without expectation of\ncompensation or charge to the individual, and  without payment or reimbursement\nby any governmental agency or insurer. The health care services shall be provided\nto charitable organizations only. A temporary license issued under this section shall\nbe valid for no more than a ten (10) day period during any given charitable event.\n(2) To obtain the temporary license issued under subsection (1) of this section, the\ndentist or dental hygienist shall:\n(a) Apply online or in writing to the Board of Dentistry at least thirty (30) days\nprior to providing the health care services under subsection (1) of this section;\n(b) Submit himself or herself for a National Practitioner Databank query to be\nconducted by the board.\n(3) Prior to beginning the services permitted under subsection (1) of this section, the\ndentist or dental hygienist shall notify the appropriate agent in the Cabinet for\nHealth and Family Services.\n(4) A dentist or dental hygienist working under this section may perform all preventive\nprocedures and treatments including but not limited to scaling, p rophylaxis,\nradiographs, sealants, and fluoride application.\n(5) In addition to the procedures permitted under subsection (4) of this section, a dentist\nmay perform those procedures or treatments considered to be routine in nature and\nthat are typically performed and completed in one (1) appointment. The procedures\ninclude simple extractions and basic restorative procedures. All procedures\nperformed other than those provided in this subsection and subsection (4) of this\nsection shall be performed by a denti st holding a currently valid license in the\nCommonwealth.\n(6) A dentist or dental hygienist working under this section who registers as a charitable\nhealth care provider under KRS 216.941 shall be eligible for the provision of\nmedical malpractice insurance procured under KRS 304.40-075.\n(7) The board may waive the requirements of subsections (1), (2), and (3) of this\nsection and the requirements of KRS 313.035 and 313.040 for a dentist or dental\nhygienist who volunteers to provide dental services through a nonprofit, all -\nvolunteer charitable organization.\n(8) The board shall promulgate administrative regulations that are reasonably necessary\nto administer this section.\n(9) Any person or organization that conducts a nonprofit charitable dentistry event shall\nbe granted immunity from civil liability in accordance with KRS 411.200.","path":["KRS Chapter 313"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30842","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:09Z","sha256":"2087a6f7d46b16c16df84ee36da7ee50d19d720ff2e893e6cfff889f253b9292","source_id":"us-ky","stale":false,"prev":"us-ky/krs-313.253","next":"us-ky/krs-313.255"},"notice":"GroundRules: Original legal text.
