{"data":{"id":"us-ky/krs-314.085","jurisdiction":"us-ky","citation":"KRS 314.085","heading":"Mental health, neuropsychological, psychosocial, psychosexual, substance","body":"use disorder, or physical evaluation of licensee or applicant -- Suspension or\ndenial of application until person submits to evaluation.\n(1) If the board has reasonable cause to believe that any licensee; applicant for licensure\nby examination, endorsement, reinstatement, or change of status; holder of the\nprivilege to practice as a nurse; credential holder; or holder of a temporary work\npermit is unable to practice with reasonable skill and safety or has abused alcohol or\ndrugs, it may require the person to submit to a mental health, neuropsychological,\npsychosocial, psychosexual, substance use disorder, or physical evaluation by a\nlicensed or certified practitioner designa ted by the board. Upon the failure of the\nperson to submit the evaluation within thirty (30) days, unless due to circumstances\nbeyond the person's control, the board may initiate an action for immediate\ntemporary suspension pursuant to KRS 314.089 or deny the application until the\nperson submits to the required evaluation.\n(2) Every licensee; applicant for licensure by examination, endorsement, reinstatement,\nor change of status; holder of the privilege to practice as a nurse; credential holder;\nor holder o f a temporary work permit shall be deemed to have given consent to\nsubmit to a mental health, neuropsychological, psychosocial, psychosexual,\nsubstance use disorder, or physical evaluation when so directed in writing by the\nboard. The direction to submit to an evaluation shall contain the basis of the board's\nreasonable cause to believe that the person is unable to practice with reasonable\nskill and safety, or has abused alcohol or drugs. The person shall be deemed to have\nwaived all objections to the admis sibility of the examining practitioner's testimony\nor examination reports on the ground of privileged communication.\n(3) The licensee; applicant for licensure by examination, endorsement, reinstatement, or\nchange of status; holder of the privilege to pract ice as a nurse; credential holder; or\nholder of a temporary work permit shall bear the cost of any mental health,\nneuropsychological, psychosocial, psychosexual, substance use disorder, or physical\nevaluation ordered by the board.","path":["KRS Chapter 314"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48250","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:10Z","sha256":"33c43c8f7b8c4f3d601587f1eb0c870636eab1cce88f1b2fba26cc1eaad53f6c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-314.081","next":"us-ky/krs-314.089"},"notice":"GroundRules: Original legal text.
