{"data":{"id":"us-ky/krs-314.089","jurisdiction":"us-ky","citation":"KRS 314.089","heading":"Immediate temporary suspension of license against which disciplinary","body":"action or investigation is pending -- Procedure.\n(1) The board's president or the president's designee may determine that immediate\ntemporary suspension of a license or privil ege against which disciplinary action or\nan investigation is pending is necessary in order to stop, prevent, or avoid\nimmediate danger to the public health, safety, or welfare. When it appears that this\naction may be necessary, the executive director or th e executive director's designee\nshall issue an emergency order suspending the nurse's license or privilege. Upon\nappeal of an emergency order, an emergency hearing shall be conducted in\naccordance with KRS 13B.125.\n(2) No board member shall be disqualified  from serving on a disciplinary action\nhearing panel for the reason that he has previously sat on a hearing panel\nconsidering temporary suspension of the same license or privilege.\n(3) The board shall expedite disciplinary actions in which a license or pri vilege has\nbeen temporarily suspended.\n(4) The order of immediate temporary suspension shall remain in effect until either\nreconsidered or superseded by final disciplinary action by the board.","path":["KRS Chapter 314"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48251","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:10Z","sha256":"91661f83b647ebebebd0c07f9c42ff7ed9e3b1fa22d403e29c33206647f5f481","source_id":"us-ky","stale":false,"prev":"us-ky/krs-314.085","next":"us-ky/krs-314.090"},"notice":"GroundRules: Original legal text.
