{"data":{"id":"us-ky/krs-314.131","jurisdiction":"us-ky","citation":"KRS 314.131","heading":"Board meetings -- Administrative regulations -- Officers -- Quorum --","body":"Duties -- Executive director -- Compensation of members -- Liability insurance\n-- Expunging of disciplinary action records.\n(1) The board shall meet at least annually a nd shall elect from its members a president\nand any other officers that it deems necessary. Nine members of the board including\none (1) officer shall constitute a quorum at any meeting. The board is authorized to\npromulgate administrative regulations not i nconsistent with the law and subject to\nthe provisions of KRS Chapter 13A, as may be necessary to enable it to carry into\neffect the provisions of this chapter. The board may require, by administrative\nregulation, that licensees and applicants utilize a sp ecific method of submission of\ndocuments or information that is required to be provided to the board under this\nchapter and the administrative regulations of the board, including electronic\nsubmission.\n(2) The board shall approve programs of nursing and sh all monitor compliance with\nstandards for nurse competency under this chapter. It shall examine, license, and\nrenew the license of duly-qualified applicants; determine notice of place and time of\nlicensure examinations; approve providers of continuing educ ation; administer\ncontinuing education requirements; issue advisory opinions or declaratory rulings\ndealing with the practice of nursing; register and designate those persons qualified\nto engage in advanced nursing practice; and it shall conduct administra tive hearings\nin accordance with KRS Chapter 13B upon charges calling for discipline of a\nlicensee and cause the prosecution of all persons violating any provisions of this\nchapter. It shall keep a record of all its proceedings and make an annual report to\nthe Governor.\n(3) The board shall develop specific guidelines to follow upon receipt of an allegation\nof sexual misconduct by a nurse licensed by the board. The guidelines shall include\ninvestigation, inquiry, and hearing procedures which ensure that the process does\nnot revictimize the alleged victim or cause harm if a nurse is falsely accused.\n(4) The board and investigators hired by the board shall receive training on the\ndynamics of sexual misconduct of professionals, including the nature of this abuse\nof authority, characteristics of the offender, the impact on the victim, the possibility\nand the impact of false accusations, investigative procedure in sex offense cases,\nand effective intervention with victims and offenders.\n(5) The board shall employ a  qualified person to serve as executive director to the\nboard, and shall fix the compensation and define the duties of the executive\ndirector. It may employ other persons as may be necessary to carry on the work of\nthe board.\n(6) The executive director shall have at least the qualifications for board members, and\na master's degree in nursing or equivalent and shall have had at least two (2) years\nof experience in nursing administration immediately preceding the time of\nappointment.\n(7) With the approval of the board, the executive director may hire additional officers\nand other personnel necessary for the proper functioning of the board, fix their\nsalaries, and prescribe their duties. Any person employed under this section shall\nnot be subject to the provisions of KRS Chapter 18A.\n(8) Each member of the board shall receive, in addition to traveling, hotel, and other\nnecessary expenses, one hundred fifty dollars ($150) for each day the member is\nactually engaged in the discharge of official duties.\n(9) The boa rd may, in its discretion, purchase liability insurance for board and staff\nmembers against acts performed in good faith discharge of duties.\n(10) The board may, by administrative regulation issued pursuant to the provisions of\nKRS Chapter 13A, determine w hich disciplinary action records may be expunged.\nAny records which are expunged shall be exempt from disclosure under the\nKentucky Open Records Law, KRS 61.870 to 61.884. The board shall not report its\ndisciplinary actions for any purpose other than statistical.\n(11) The board may reimburse any person appointed by direction of the board to any\ncommittee, subcommittee, or task force created by the board for his or her travel\nand subsistence expenses as established through the promulgation of administrative\nregulations in accordance with KRS Chapter 13A.","path":["KRS Chapter 314"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55599","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:10Z","sha256":"4880e98a25fbe7b80fca423157717685d502f692653e4356b3bea6c2d8f52e0f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-314.130","next":"us-ky/krs-314.133"},"notice":"GroundRules: Original legal text.
