{"data":{"id":"us-ky/krs-314.155","jurisdiction":"us-ky","citation":"KRS 314.155","heading":"Duty of treating nurse utilizing telehealth to ensure patient's informed","body":"consent and maintain confidentiality -- Board to promulgate administrative\nregulations -- Definition of \"telehealth\".\n(1) A treating nurse who provides or facilitates the use of telehealth shall ensure:\n(a) That the informed consent of the patient, or another appropriate person with\nauthority to make the health care treatment decision for the patient, is obtained\nbefore services are provided through telehealth; and\n(b) That the co nfidentiality of the patient's medical information is maintained as\nrequired by this chapter and other applicable law. At a minimum,\nconfidentiality shall be maintained through appropriate processes, practices,\nand technology as designated by the board and  that conform to applicable\nfederal law.\n(2) The board shall promulgate administrative regulations in accordance with KRS\nChapter 13A to implement this section and as necessary to:\n(a) Prevent abuse and fraud through the use of telehealth services;\n(b) Prevent fee-splitting through the use of telehealth services; and\n(c) Utilize telehealth in the provision of nursing services and in the provision of\ncontinuing education.\n(3) For purposes of this section, \"telehealth\" means the use of interactive audio, vide o,\nor other electronic media to deliver health care.
