{"data":{"id":"us-ky/krs-314.402","jurisdiction":"us-ky","citation":"KRS 314.402","heading":"Licensed Certified Professional Midwives Advisory Council -- Members --","body":"Terms -- Authority and responsibility -- Administrative regulations governing\nlicensee's duty to keep appropriate medical records.\n(1) The Licensed Certified Professional M idwives Advisory Council is hereby created,\nunder the Board of Nursing. The council shall at regular intervals and guided by\nnewly available evidence in peer -reviewed medical literature, advise the board on\npromulgating administrative regulations regarding  qualifications, standards for\ntraining, competency determination of licensed certified professional midwives, any\nnecessary statutory changes, and all other matters relating to licensed certified\nprofessional midwives.\n(2) The council shall be appointed by the board and shall consist of:\n(a) One (1) member of the board, who shall be a nonvoting, ex officio member\nand serve as the liaison between the chair of the council and the board;\n(b) Three (3) certified professional midwives who shall be licensed cert ified\nprofessional midwives within six (6) months of the license availability;\n(c) Two (2) APRN-designated certified nurse-midwives licensed in Kentucky;\n(d) Two (2) obstetricians licensed in Kentucky;\n(e) One (1) practicing neonatal health care provider licensed in Kentucky; and\n(f) One (1) member of the general public.\nThe chair of the council shall be elected annually by members of the council.\n(3) The board may solicit nominations for the council from interested parties or\norganizations and shall give c onsideration to nominees who have experience\ncollaborating with providers of, providing, or utilizing out -of-hospital midwifery\nservices.\n(4) The board shall specify the terms for the council members, not to exceed four (4)\nyears. Members shall serve at the discretion of the board, may be reappointed at the\nend of their terms, and shall receive reimbursement for their actual and necessary\nexpenses incurred in the performance of their official duties.\n(5) A licensed certified professional midwife has the sam e authority and responsibility\nas appropriate licensed health care providers regarding following public health laws,\nreporting reportable diseases and conditions, controlling and preventing\ncommunicable diseases, recording of vital statistics, obtaining he alth histories, and\nperforming physical examinations, except that this authority is limited to activity\nconsistent with provision of services authorized by KRS 314.400 to 314.414.\n(6) A licensed certified professional midwife shall keep appropriate medical  records\nregarding treatment and outcomes as required by the board by administrative\nregulation.","path":["KRS Chapter 314"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48874","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:11Z","sha256":"f5179966cc976cbd203ec6662423a4b9cad9e798cc958d99fb5add558871c19c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-314.400","next":"us-ky/krs-314.404"},"notice":"GroundRules: Original legal text.
