{"data":{"id":"us-ky/krs-314.408","jurisdiction":"us-ky","citation":"KRS 314.408","heading":"Prohibited activities.","body":"(1) It shall be unlawful for any person to provide certified professional midwifery\nservices as defined in KRS 314.400 unless that person is a licensed certified\nprofessional midwife currently issued a license by the board in accordance with\nKRS 314.400 to 314 .414 or is an appropriate licensed health care provider\nproviding services that are within his or her scope of practice.\n(2) It shall be unlawful for any person to hold herself or himself out as a licensed\ncertified professional midwife or other skilled bi rth attendant authorized to provide\nprenatal care or manually assist in the delivery of an infant, or to provide the\nservices defined in KRS 314.400(2) in Kentucky unless he or she has been issued a\nlicense by the board in accordance with KRS 314.400 to 314.414.\n(3) It shall be unlawful for any person to operate or to offer to operate or to represent or\nadvertise the operation of a school or program of certified professional midwifery\nunless the school or program has been approved by the board to do so.\n(4) It shall be unlawful for any licensed certified professional midwife or employer of a\nlicensed certified professional midwife having knowledge of facts to refrain from\nreporting to the board a licensed certified professional midwife who violates any\nprovision set forth in administrative regulation for licensed certified professional\nmidwives.\n(5) It shall be unlawful for any person to provide certified professional midwifery\nservices who is listed on the nurse aide abuse registry with a substantiated findi ng\nof abuse, neglect, or misappropriation of property.\n(6) Nothing in KRS 314.400 to 314.414 shall prohibit a traditional birth attendant\nproviding midwifery services without a license if the traditional birth attendant has\ncultural or religious traditions  that have historically included the attendance of\ntraditional birth attendants at birth, and the birth attendant serves only women and\nfamilies in that distinct cultural or religious group.\n(7) Nothing in KRS 314.400 to 314.414 shall prohibit an appropria te licensed health\ncare provider or other person from providing emergency care, including care of a\nprecipitous delivery.\n(8) In accordance with KRS 311.723, a licensed certified professional midwife issued a\nlicense by the board in accordance with KRS 314 .400 to 314.414 shall not perform\nan abortion.\n(9) Nothing in KRS 314.400 to 314.414 shall prohibit a person from providing self -\ncare, or uncompensated care to a friend or family member, as long as the person\ndoes not hold himself or herself out to be a m idwife or provider of certified\nprofessional midwifery services as defined under KRS 314.400.\n(10) Nothing in KRS 314.400 to 314.414 shall prohibit an employee or other individual\nwho is assisting, and under the direct supervision of, a licensed certified\nprofessional midwife from performing activities or functions that are delegated by\nthe licensed certified professional midwife and are within the licensed certified\nprofessional midwife's scope of practice as authorized by the board.\n(11) Nothing in KRS 31 4.400 to 314.414 shall prohibit an individual from performing\nactivities or functions that are delegated by the licensed certified professional\nmidwife if that individual is a student of midwifery in a training program operating\nas authorized by the board,  and is under the direct supervision of a qualified\npreceptor as authorized by the board.","path":["KRS Chapter 314"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48877","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:11Z","sha256":"7040ee7e4567c6330fada251492e8a58c47945c7ae762962c28311ec96b7ae00","source_id":"us-ky","stale":false,"prev":"us-ky/krs-314.406","next":"us-ky/krs-314.410"},"notice":"GroundRules: Original legal text.
