{"data":{"id":"us-ky/krs-314a.220","jurisdiction":"us-ky","citation":"KRS 314A.220","heading":"Mandatory certificate fees -- Renewal, restoration, and reinstatement.","body":"(1) The board shall issue a mandatory certificate to all applicants who meet the\nrequirements of this chapter and who pay to the board the initial mandatory\ncertificate fee.\n(2) The amount of fees prescribed in connection with a mandatory certificate as a\nrespiratory care practitioner shall be prescribed by administrative regulation\npromulgated by the board in accordance with KRS Chapter 13A.\n(3) Each respiratory care mandatory certificate shall expire on January 30 every two (2)\nyears. No person who applies for renewal, whose mandatory certificate has expired,\nshall be required to submit to any examination as a condition to renewal, provided\nsuch renewal application is made within five (5) years from the date of such\nexpiration. No person shall practice respir atory care in this state unless the\nindividual holds a valid certificate. All mandatory certificates not renewed by\nJanuary 30 following the date of issuance shall be deemed expired.\n(4) A suspended mandatory certificate is subject to expiration and shall be renewed as\nprovided in this chapter, but such renewal shall not entitle the respiratory care\npractitioner, while the mandatory certificate remains suspended, and until it is\nreinstated, to engage in mandatory certification activities, or in any other ac tivity or\nconduct in violation of the order of judgment by which the mandatory certificate\nwas suspended. A mandatory certificate revoked on disciplinary grounds is subject\nto expiration as provided in this chapter, but it may not be renewed. If it is\nreinstated after its expiration, the mandatory certificate holder, as a condition of\nreinstatement, shall pay a reinstatement fee in an amount equal to the renewal fee in\neffect on the last preceding regular renewal date before the date on which it is\nreinstated, plus the delinquency fee, if any, accrued at the time of its revocation.\n(5) A person who fails to renew his or her mandatory certificate within the five (5)\nyears after its expiration may not renew it, and it may not be restored, reissued, or\nreinstated thereafter, but such persons may apply for and obtain a new mandatory\ncertificate if he meets the requirements of this chapter.","path":["KRS Chapter 314A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30983","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:11Z","sha256":"0adf905ed75e3105ccc7e623d5ea969c371dd48dc05aa5295a61c6dc0ae0bb0e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-314a.215","next":"us-ky/krs-314a.225"},"notice":"GroundRules: Original legal text.
