{"data":{"id":"us-ky/krs-314a.225","jurisdiction":"us-ky","citation":"KRS 314A.225","heading":"Denial, suspension, probation, or revocation of certificate -- Grounds --","body":"Administrative fine -- Reprimand or admonishment -- Reinstatement of\ncertificate.\n(1) The board may refuse to issue a certificate, or may suspend, revoke, impose\nprobationary conditions upon, impose an administrative fine, issue a written\nreprimand or admonishment, or any combination thereof regarding any certificate\nholder upon proof that the certificate holder has:\n(a) Committed any crime, act of dishonesty, or corrupti on, if in accordance with\nKRS Chapter 335B. If the act constitutes a crime, conviction in a criminal\nproceeding is not a condition precedent to disciplinary action. Upon\nconviction of the crime, the judgment and sentence are presumptive evidence\nat the ens uing disciplinary hearing of the guilt of the certificate holder or\napplicant. Conviction includes all instances in which a plea of no contest is\nthe basis of conviction;\n(b) Misrepresented or concealed a material fact in obtaining, renewing or\nreinstating a certificate;\n(c) Committed any unfair, false, misleading, or deceptive act or practice;\n(d) Been incompetent or negligent in the practice of respiratory care;\n(e) Violated any state statute or administrative regulation governing the practice\nof respirat ory care or any activities undertaken by a respiratory care\npractitioner, which shall include violation of KRS 304.39 -215 and conduct\nthat is subject to the penalties under KRS 304.99-060(4) or (5);\n(f) Failed to comply with an order issued by the board or  an assurance of\nvoluntary compliance;\n(g) Violated the code of ethics as set forth in administrative regulations\npromulgated by the board; or\n(h) Violated any applicable provision of any federal or state law, if in accordance\nwith KRS Chapter 335B.\n(2) One (1) year from the date of revocation, any person whose certificate has been\nrevoked may petition the board for reinstatement. The board shall investigate the\npetition and may reinstate the certificate upon a finding that the individual has\ncomplied with any terms prescribed by that board and is again able to competently\nengage in the practice of respiratory care.\n(3) The board may reconsider, modify, or reverse its probation, suspensions, or other\ndisciplinary actions.\n(4) The surrender of a certificate s hall not serve to deprive the board of jurisdiction to\nproceed with disciplinary action under this chapter.","path":["KRS Chapter 314A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49062","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:11Z","sha256":"d4c8617d3d9d0fb79d237ed09763a6bbe9a754ce32c4248956010e72c5aacbc9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-314a.220","next":"us-ky/krs-314a.230"},"notice":"GroundRules: Original legal text.
