{"data":{"id":"us-ky/krs-315.020","jurisdiction":"us-ky","citation":"KRS 315.020","heading":"Only pharmacists to supervise manufacturing of pharmaceuticals or","body":"practice pharmacy -- Exceptions -- Access to pharmacy electronic database\nallowed under specific conditions -- Persons employed to assist practice of\npharmacy after April 1, 2009, to be registered pharmacy technicians or exempt\nunder KRS 315.135.\n(1) No owner of a pharmacy who is not a pharmacist shall fail to place a pharmacist in\ncharge of his or her pharmacy or shall permit any person to compound or dispense\nprescription drugs, medicines, or pharmaceuticals in his or her place of business\nexcept in the presence and under the immediate supervision of a pharmacist.\n(2) No manufacturer of pharmaceuticals who is not a pharmacist shall fail to place a\npharmacist in charge of hi s or her place of business or shall permit any person to\ncompound prescription drugs, medicines, or pharmaceuticals in his or her place of\nbusiness, except as provided by the board through the promulgation of\nadministrative regulations pursuant to KRS Chapter 13A.\n(3) Except as provided in subsection (4) of this section, no person shall engage in the\npractice of pharmacy unless licensed to practice under the provisions of KRS\nChapter 315.\n(4) The provisions of subsection (3) of this section shall not apply to:\n(a) Pharmacist interns performing professional practice activities under the\nimmediate supervision of a licensed pharmacist. The nature and scope of the\nactivities referred to in this paragraph shall be determined by the board\nthrough administrative regulation promulgated pursuant to KRS Chapter 13A;\n(b) Pharmacist interns and pharmacy technicians performing specifically\nidentified pharmacy practice activities while under the supervision of a\npharmacist. The nature and scope of the activities referred t o in this paragraph\nshall be determined by the board through administrative regulation\npromulgated pursuant to KRS Chapter 13A;\n(c) Other licensed health care professionals practicing within the statutory scope\nof their professional practices; or\n(d) Volunteer health practitioners providing services under KRS 39A.350 to\n39A.366.\n(5) (a) As used in this subsection:\n1. \"Order entry\" means the process by which pharmacy personnel validate\nprescription data and enter that data into a pharmacy's dispensing or\nmedication management system. Prescription data includes but is not\nlimited to patient demographics, prescriber demographics, drug name,\nstrength, dosage form, quantity, the directions for use, refill\nauthorization, or any clarifications of the same; and\n2. \"Order entry verification\" means the process by which a pharmacist\nverifies prescription data entered in a pharmacy's dispensing or\nmedication management system after order entry has been completed.\n(b) Nothing in this chapter shall prohibit a pharmacist li censed in Kentucky, or a\npharmacy technician registered in Kentucky or a pharmacy intern certified in\nKentucky who is working under the supervision of the pharmacist, from\naccessing the electronic database of the pharmacy, from inside or outside of\nthe pharmacy, to perform order entry, order entry verification, or drug regimen\nreview as defined in KRS 315.010, if:\n1. The pharmacy has established controls to protect the confidentiality and\nintegrity of protected health information;\n2. No part of the pharmacy's database is duplicated, downloaded, or\nremoved from the electronic database; and\n3. The pharmacy is located in Kentucky and is permitted by the board.\n(c) Supervision required by paragraph (b) of this subsection may include\nelectronic supervision.\n(d) This subsection shall only apply to:\n1. Pharmacies that are not open to the public and do not dispense to walk -\nin patients in a retail setting; or\n2. Hospitals licensed under KRS Chapter 216B.\n(e) Nothing in this subsection shall be c onstrued to authorize final product\nverification and dispensing of a prescription from a location outside of or\nother than a pharmacy.\n(f) Nothing in this subsection permits pharmacists, pharmacy technicians, or\npharmacy interns to receive hard copy prescriptions outside of the premises of\na permitted pharmacy.\n(6) Effective April 1, 2009, an owner of a pharmacy shall not employ a person to assist\nin the practice of pharmacy unless the person is registered as a pharmacy technician\nby the board or exempt under KRS 315.135.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52674","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:11Z","sha256":"35e3485eca4138207c9f4796e25f28d8ee26c08ae176c27fc2af8c1a03143ae8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.010","next":"us-ky/krs-315.030"},"notice":"GroundRules: Original legal text.
