{"data":{"id":"us-ky/krs-315.040","jurisdiction":"us-ky","citation":"KRS 315.040","heading":"Exceptions to chapter.","body":"(1) Nothing in this chapter shall be construed to prevent, restrict, or otherwise interfere\nwith the sale of nonprescription drugs in their original packages by any retailer. No\nrule or regulation shall be adopted by the Board of Pharmacy under this chapter\nwhich shall require the sale of nonprescription drugs by a licensed pharmacist or\nunder the supervision of a licensed pharmacist.\n(2) Nothing in this chapter shall interfere with the professional activities of any licensed\npracticing physician, or prevent th e physician from keeping any drug or medicine\nthat he or she may need in his or her practice, from compounding the physician's\nown medications, or from dispensing or supplying to patients any article that seems\nproper to the physician.\n(3) Nothing in this chapter pertaining to the use of collaborative care agreements shall\napply in any hospital or other health facility operated by a hospital without the\nexpress written permission of the hospital's governing body. Collaborative care\nagreements may be restricted by the policies and procedures of the facility.\n(4) Nothing in this chapter shall interfere with the activities of a physician assistant as\nauthorized in KRS Chapter 311.\n(5) Nothing in this chapter shall interfere with the activities of an advanced pr actice\nregistered nurse as authorized in KRS Chapter 314.\n(6) Nothing in this chapter shall be construed to prevent, restrict, or otherwise interfere\nwith the sale or distribution of dialysate solutions as defined in KRS 315.0351 or\ndevices necessary to pe rform home peritoneal dialysis to patients with end -stage\nrenal disease, provided that the requirements established in KRS 315.0351(2) are\nsatisfied. No rule or administrative regulation shall be adopted or promulgated by\nthe board under this chapter that requires the sale or distribution of dialysate\nsolutions as defined in KRS 315.0351 or devices necessary to perform home\nperitoneal dialysis by a licensed pharmacist or under the supervision of a licensed\npharmacist.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49249","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:11Z","sha256":"2079366c8931fd0fb3d7af7195ab9f0e96fd7a4d0d525fa1796d63a1d015b003","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.038","next":"us-ky/krs-315.050"},"notice":"GroundRules: Original legal text.
