{"data":{"id":"us-ky/krs-315.125","jurisdiction":"us-ky","citation":"KRS 315.125","heading":"Mental or physical examination ordered by board -- Effect of failure to","body":"submit to examination.\n(1) When the board has probable cause to believe a pharmacist, pharmacy technician,\nlicensee, certificate holder, or permit holder is suffering from a men tal or physical\ncondition that might impede that person's ability to practice competently, the board\nmay order the individual to undergo a mental or physical examination by an\nappropriately-trained professional designated by the board.\n(2) Failure of a pharmacist, pharmacy technician, licensee, or permit holder to submit to\nsuch an examination when directed, unless the failure was due to circumstances\nbeyond his or her control, shall constitute an admission that he or she has developed\nsuch a mental or phys ical disability, or other condition, that continued practice is\ndangerous to patients or to the public. Failure to attend the examination shall\nconstitute a default, and a final order suspending, limiting, restricting, or revoking\nthe license or permit may be entered without the taking of testimony or presentation\nof evidence.\n(3) A pharmacist, pharmacy technician, licensee, or permit holder whose license has\nbeen suspended, limited, restricted, or revoked pursuant to this section shall at\nreasonable interv als be afforded an opportunity, pursuant to KRS 315.121(4), to\ndemonstrate that he can resume the competent practice of pharmacy with reasonable\nskill and safety to patients.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45256","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:11Z","sha256":"71d09b2b1fd69be687d8712c1477ee6c32e4f78b780a7d05e9becc088483478d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.123","next":"us-ky/krs-315.126"},"notice":"GroundRules: Original legal text.
