{"data":{"id":"us-ky/krs-315.126","jurisdiction":"us-ky","citation":"KRS 315.126","heading":"Pharmacist recovery network committee -- Administrative regulations --","body":"Assessment -- Confidentiality -- Reporting restrictions.\n(1) The board shall establish a pharmacist recovery network committee to promote the\nearly identification, intervention, tr eatment, and rehabilitation of pharmacists and\npharmacist interns who may be impaired by reason of illness, alcohol or drug abuse,\nor as a result of any other physical or mental condition.\n(2) The board may enter into a contractual agreement with a nonprof it corporation,\npharmacy professional organization, or similar organization for the purpose of\ncreating, supporting, and maintaining a pharmacist recovery network committee.\n(3) The board may promulgate administrative regulations pursuant to KRS Chapter\n13A to effectuate and implement the provisions of this section.\n(4) Beginning July 15, 1998, the board shall collect an assessment of ten dollars ($10)\nto be added to each licensure renewal application fee payable to the board. This\nassessment shall be expen ded by the board on the operation of the pharmacist\nrecovery network committee.\n(5) Members of a pharmacist recovery network committee, any administrator, staff\nmember, consultant, agent, volunteer, or employee of the committee acting within\nthe scope of h is or her duties and without actual malice and all other persons who\nfurnish information to the committee in good faith and without actual malice shall\nnot be liable for any claim or damages as a result of any statement, decision,\nopinion, investigation, o r action taken by the committee or by any individual\nmember of the committee.\n(6) All information, interviews, reports, statements, memoranda, or other documents\nfurnished to or produced by the pharmacist recovery network committee, all\ncommunications to o r from the committee, and all proceedings, findings, and\nconclusions of the committee, including those relating to intervention, treatment, or\nrehabilitation, that in any way pertain or refer to a pharmacist or pharmacist intern\nwho is or may be impaired shall be privileged and confidential.\n(7) All records and proceedings of the committee that pertain or refer to a pharmacist or\npharmacist intern who is or may be impaired shall be privileged and confidential,\nused by the committee and its members only in t he exercise of the proper function\nof the committee, not be considered public records, and not be subject to court\nsubpoena, discovery, or introduction as evidence in any civil, criminal, or\nadministrative proceedings, except as described in subsection (8) of this section.\n(8) The committee may only disclose the information relative to an impaired\npharmacist or pharmacist intern if:\n(a) It is essential to disclose the information to persons or organizations needing\nthe information in order to address the in tervention, treatment, or\nrehabilitation needs of the impaired pharmacist or pharmacist intern;\n(b) The release is authorized in writing by the impaired pharmacist or pharmacist\nintern; or\n(c) The committee is required to make a report to the board pursuan t to KRS\n315.121.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31010","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:11Z","sha256":"c33a9bf2095dea1bf4b5ef907a97ac42ad545990e334b6ed2798e8998ed4c672","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.125","next":"us-ky/krs-315.127"},"notice":"GroundRules: Original legal text.
