{"data":{"id":"us-ky/krs-315.202","jurisdiction":"us-ky","citation":"KRS 315.202","heading":"Exercise of judgment by pharmacist to dispense varying quantities","body":"of prescription drug per fill.\n(1) Notwithstanding any statute to the contrary, unless the practitioner has\nspecified on the prescription drug order that dispensing a prescription for a\nnoncontrolled maintenance drug in an initial amount followed by periodic refills\nis medically necessary, a pharmacist may exercise professional judgment to\ndispense varying quantities of the prescribed drug per fill up to the total number\nof dosage units as authorized by the practitioner on the prescription drug order,\nincluding any refills, up to a ninety (90) day supply.\n(2) This section does not apply to controlled substances or to any drugs for which\na  report is required to the electronic system  for monitoring controlled\nsubstances established in KRS 218A.202.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46511","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"23bb8ab0a6053b581d7e1c0fbd48f7a9b050fb248c78475b1f54f65b1b127990","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.200","next":"us-ky/krs-315.205"},"notice":"GroundRules: Original legal text.
