{"data":{"id":"us-ky/krs-315.295","jurisdiction":"us-ky","citation":"KRS 315.295","heading":"Automated pharmacy system in residential hospice facilities.","body":"(1) As used in this section and KRS 315.300:\n(a) \"Automated pharmacy system\" means a mechanical system that delivers\nprescribed over -the-counter and legend drugs, and controlled substances\nreceived from a pharmacy licensed in Kentucky that maintains transactio n\ninformation; and\n(b) \"Residential hospice facility\" means a facility licensed under KRS Chapter\n216B that provides residential skilled nursing care, pain management, and\ntreatment for acute and chronic conditions for terminally ill patients.\n(2) A pharmacy may provide pharmacy services to a residential hospice facility through\nthe use of an automated pharmacy system under the supervision of a licensed\npharmacist pursuant to the policies, procedures, and protocol established by the\nKentucky Board of Pharma cy. The supervising pharmacist shall not be required to\nbe physically present at the location of the automated pharmacy system and\nsupervision may be provided electronically.\n(3) Drugs stored in bulk or unit dose in an automated pharmacy system in a reside ntial\nhospice facility shall be considered the inventory of the pharmacy providing\nservices to the facility and drugs delivered through the automated pharmacy system\nshall be considered dispensed by the pharmacy.\n(4) The Kentucky Board of Pharmacy shall pr omulgate administrative regulations\npursuant to KRS Chapter 13A to implement the provisions of this section that shall\ninclude but not be limited to:\n(a) Accuracy of the automated pharmacy system;\n(b) Security of the system;\n(c) Recordkeeping, including bu t not limited to electronic signatures of\nauthorized users;\n(d) Inventory management;\n(e) Labeling or reporting requirements that include identification of the\ndispensing pharmacy, the prescription number, the name of the patient, and\nthe name of the prescriber; and\n(f) Training for authorized users.\n(5) Nothing in this section shall be construed to limit or impede pharmacy practice in\nKentucky.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31036","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"02a1d3e1f94e119f83d7ed63dd5f6e26b0c2c578c036f46b7a5f9da2bc79137a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.235","next":"us-ky/krs-315.300"},"notice":"GroundRules: Original legal text.
