{"data":{"id":"us-ky/krs-315.300","jurisdiction":"us-ky","citation":"KRS 315.300","heading":"Placement of drugs by pharmacy with authorized employees of home","body":"health agencies and hospices -- Protocol -- Allowable legend drugs --\nAdministrative regulations.\n(1) A pharmacy shall be allowed to place drugs with a home health agency's authorized\nemployees and with a hospice's authorized employees for the betterment of public\nhealth. The pharmacy shall remain the legal owner of the drugs.\n(2) A written agreement between the pharmacy and home health agency or hospice\nshall document the protocol for th e handling and storage of the drugs by authorized\nemployees and shall be approved by the pharmacist in charge.\n(3) The pharmacist in charge shall review the protocol to assure that safe, secure and\naccountable handling of controlled legend drugs is maintai ned under the protocol\nbefore giving approval.\n(4) The pharmacist in charge or a pharmacist designee shall physically inspect and\nreview the drug storage and handling at the home health agency and the hospice not\nless than annually.\n(5) The home health agency and the hospice protocol shall include but not be limited to\nthe following:\n(a) Safe and secure storage of drugs;\n(b) Access to drugs limited to authorized employees;\n(c) Records of drugs checked out to authorized employees and records of drugs,\namounts, and to whom and by whom administered;\n(d) Prompt notification of the pharmacy when a drug is used, including the\nprescriber, patient, drug, dosage form, directions for use and other pertinent\ninformation;\n(e) Billing information;\n(f) Procedures for handling drugs beyond their expiration date; and\n(g) Inventory control.\n(6) The following legend drugs shall be allowed under these agreements:\n(a) Sterile water for injection or irrigation;\n(b) Sterile saline solution for injection or irrigation;\n(c) Heparin flush solution;\n(d) Diphenhydramine injectable;\n(e) Epinephrine injectable;\n(f) Glucagon;\n(g) Influenza vaccine; and\n(h) Pneumonia vaccine.\n(7) As used in this section:\n(a) \"Authorized employee\" means any employee of a home health agency or\nhospice who, in the course of the employee's duties, is licensed by the\nemployee's appropriate licensing agency to administer legend drugs;\n(b) \"Home health agency\" means an entity required to be licensed under KRS\nChapter 216; and\n(c) \"Hospice\" means an entity a uthorized to hold itself out to the public as a\nhospice or as a licensed hospice pursuant to KRS Chapter 216.\n(8) The cabinet shall promulgate administrative regulations to implement the provisions\nof this section.\n(9) Nothing in this section shall preclud e or prevent a pharmacy from providing\npharmacy services through an automated pharmacy system to a residential hospice\nfacility in accordance with KRS 315.295.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31037","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"cb626567baeb64eab228553ef44d574c14ba79cc4e744871d9f1883384431c72","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.295","next":"us-ky/krs-315.310"},"notice":"GroundRules: Original legal text.
