{"data":{"id":"us-ky/krs-315.330","jurisdiction":"us-ky","citation":"KRS 315.330","heading":"Seizure and forfeiture of illegal drug shipments.","body":"(1) Any drug which is ordered or shipped in violation of any provision of this chapter\nor KRS Chapter 218A shall be considered as contraband and may be seized by any\npeace officer or any employee of the Board of Pharmacy designated to enforce the\nprovisions of this chapter or KRS Chapter 218A.\n(2) The officer, prior to seizing the drug, shall make a reasonable effort to determine:\n(a) The person who ordered the drug;\n(b) The pharmacy from which the drug was ordered;\n(c) The shipper of the drug;\n(d) The intended recipient of the drug; and\n(e) Whether or not the shipment was legal.\n(3) Unless the matter is the subject of a criminal prosecution, if, after thirty (30) days of\ninvestigation, the officer seizing the drug cannot adequately determine the\ninformation required by subsection (2) of this section, the drug that has been seized\nshall be considered as abandoned and escheat to the Commonwealth.\n(4) If a drug seized pursuant to this section is the subject of a criminal investigation, the\ndrug shall be retained as  evidence and, if there is a conviction of any person or\npharmacy relating to the ordering or shipment of the drug, the drug shall be\nforfeited to the Commonwealth. If the defendant is found not guilty or the charges\nare dismissed with prejudice, the drug shall be returned to the defendant.\n(5) Drugs which have been seized and which have been forfeited or abandoned and\nescheat to the Commonwealth shall be destroyed.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31041","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"96976d97e8132503125c25901fce8b99e909df1d60eee28b3869c392d62382a1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.325","next":"us-ky/krs-315.335"},"notice":"GroundRules: Original legal text.
