{"data":{"id":"us-ky/krs-315.402","jurisdiction":"us-ky","citation":"KRS 315.402","heading":"Licensure of wholesale distributors of prescription drugs -- Record","body":"retention -- Administrative regulations -- Confidentiality.\n(1) A wholesale distributor shall be licensed by the board under this section prior to\nengaging in the wholesale distributi on of prescription drugs in the Commonwealth.\nEach license application shall be accompanied by a reasonable fee prescribed by\nadministrative regulation not to exceed two hundred fifty dollars ($250) annually or\nincrease more than twenty-five dollars ($25) per year.\n(2) A wholesale distributor shall be required to maintain accurate records of all drugs\nhandled in accordance with KRS 315.400 to 315.412, and records shall be made\navailable to agents of the board for inspection upon request.\n(3) Licensing requirements that exceed the requirements of federal law shall not apply\nto a manufacturer distributing its own FDA-approved drugs or co-licensed products,\nunless there is reasonable cause to believe that the manufacturer presents a special\nrisk of distributing counterfeit prescription drugs in the Commonwealth.\n(4) Failure to report to the board or willful submission of inaccurate information shall\nbe grounds for disciplinary action under the provisions of KRS 315.131.\n(5) The board shall promulgate an administ rative regulation pursuant to KRS Chapter\n13A to specify the criteria for licensure in conformity with the guidelines for state\nlicensure of a wholesale prescription drug distributor issued by the FDA.\n(6) Pursuant to KRS 61.878, information provided by an  applicant under this section\nand any related administrative regulation shall not be disclosed to any person or\nentity other than the board.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31043","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"e5daae7ef06f8a4a44fabe401eff9b4605d068e1b1160df70ef90d33e1893a3a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.400","next":"us-ky/krs-315.404"},"notice":"GroundRules: Original legal text.
