{"data":{"id":"us-ky/krs-315.404","jurisdiction":"us-ky","citation":"KRS 315.404","heading":"Returns or exchanges of prescription drugs.","body":"(1) (a) A wholesale distributor may receive prescription drug returns or exchanges\nfrom a pharmacy, pharmacy warehouse, or other person authorized to\ndistribute a prescription drug to an end user under the terms and conditions of\nan agreement between the parties.\n(b) Returns of expired, damaged, recalled, or otherwise nonsalable prescription\ndrugs shall be distributed by the receiving wholesale distributor only to the\noriginal manufacturer, a third -party returns processor, or a reverse distributor\nlicensed as a wholesale distributor.\n(c) Returns or exchanges of prescription drugs that may or may not be salable,\nincluding any redistribution by a receiving wholesaler, shall not be subject to\nthe requirements of KRS 315.406 if they are exempt from the pedigree\nrequirements of the federal regulations for the federal Prescription Drug\nMarketing Act of 1987 as amended by the Prescription Drug Amendments of\n1992 and any amendments thereto.\n(2) A manufacturer or wholesale distributor shall supply prescription drugs only to a\nperson or entity licensed to possess or distribute prescription drugs to an end user.\n(3) Prescription drugs supplied by a manufacturer or wholesale distributor shall be\ndelivered only to the business address of the licensee or the address listed on the\nlicense, to the address of a health -care entity authorized by the licensee, or to an\nauthorized person or agent of the licensee at the premises of the manufacturer or\nwholesale distributor if the identity and authority of the authorized agent is\nestablished.\n(4) A licensed wholesale distributor, pharmacy, or other person authorized by law to\nfurnish prescription drugs to an end user shall be accountable for their returns\nprocess and shall ensure that all aspects of their operations are secure and do not\npermit the entry of adulterated or counterfeit prescription drugs.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31044","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"3edbf82cc168109294a81af178c12900938341312cbd4707b8e8e982424e61c1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.402","next":"us-ky/krs-315.406"},"notice":"GroundRules: Original legal text.
