{"data":{"id":"us-ky/krs-315.4106","jurisdiction":"us-ky","citation":"KRS 315.4106","heading":"Eligibility factors for initial licensure and renewal for third-party","body":"logistics provider.\n(1) The  board shall consider, at a minimum, the following factors in determining\nthe eligibility for initial licensure and renewal of third-party logistics providers:\n(a) A  finding by a law enforcement agency or regulatory agency that the\napplicant or any owners of an applicant has violated federal, state, or\nlocal laws;\n(b) Suspension, revocation, or any other sanction against a license currently\nor previously held by the applicant or any of its owners for a violation of\nfederal or state law;\n(c) A finding that the applicant or any of its owners are guilty of or pleaded\nguilty or nolo contendere to violating federal, state, or local laws;\n(d) The  furnishing by the applicant of false or fraudulent material in any\napplication;\n(e) Failure to maintain or make available to the board or to federal, state, or\nlocal law enforcement officials the records required to be maintained by\nthird-party logistics providers; and\n(f) Any  other factors or qualifications that the board considers relevant to\nand consistent with the public health and safety. Any factors inconsistent\nwith federal standards shall not be applied.\n(2) A  licensee who  has no record of providing third-party logistics services\ninvolving prescription drugs during a  routine inspection may  have  its\nsubsequent renewal application referred to the board for review and possible\ndiscipline, and the board may require the licensee to appear before the board\nat the review.\n(3) A third-party logistics provider shall have and follow a diversion detection and\nloss prevention plan that includes all prescription drugs, which shall be\nimmediately available to the board or its agents upon request.\n(4) The  board shall have the right to deny licensure if it determines that granting\nthe license would not be consistent with public health and safety.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46700","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"5b40e02ba5853811e84746ae8be5231b384bedabd899d50f829020f5120a1f67","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.4104","next":"us-ky/krs-315.4108"},"notice":"GroundRules: Original legal text.
