{"data":{"id":"us-ky/krs-315.452","jurisdiction":"us-ky","citation":"KRS 315.452","heading":"Legend  Drug Repository Program  to be established -- Purpose  --","body":"Permitted  donations  -- Voluntary  participation -- Handling  fee  --\nDistribution.\n(1) The  board shall establish and maintain a legend drug repository program to\nsupport the donation of a legend drug or supplies needed to administer a\nlegend drug for use by an individual who meets the eligibility criteria specified\nby  an administrative regulation promulgated by the board. The repository\nprogram shall not accept any controlled substance.\n(2) Donations may be made on the premises of a health facility or pharmacy that\nelects to participate in the program and meets requirements specified by the\nboard by an administrative regulation promulgated by the board.\n(3) The health facility may charge a handling fee to an individual who received a\nlegend drug or supplies under the program established under this section,\nexcept  that the fee shall not exceed  the amount  established by  an\nadministrative regulation promulgated by the board.\n(4) A  health facility or pharmacy that receives a donated legend drug under this\nsection may distribute the legend drug or supplies to another eligible health\nfacility or pharmacy for use under the program created under this section.\n(5) Nothing in this section or KRS 315.454 shall require a health facility, pharmacy,\npharmacist, or practitioner to participate in the program established in this\nsection.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46707","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"47af8427981d84b1c27081205093df672650b47ccbcd8e3cbf034df8edb6599e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.450","next":"us-ky/krs-315.454"},"notice":"GroundRules: Original legal text.
