{"data":{"id":"us-ky/krs-315.454","jurisdiction":"us-ky","citation":"KRS 315.454","heading":"Requirements  for accepting and  dispensing  legend  drug  or","body":"administration supplies.\n(1) A legend drug or supplies used to administer a legend drug may be accepted\nand  dispensed under the program established in KRS  315.452 only if the\nfollowing requirements are met:\n(a) The legend drug or supplies needed to administer the legend drug is in its\noriginal, unopened, sealed, and tamper-evident unit dose packaging or, if\npackaged  in single-unit doses, the single-unit dose  packaging is\nunopened;\n(b) The legend drug is not classified as a controlled substance;\n(c) The  legend drug or supplies needed to administer a legend drug is not\nadulterated or misbranded, as determined by a pharmacist employed by,\nor under contract with, the health facility or pharmacy, who shall inspect\nthe drug or supplies needed to administer a legend drug before the drug\nor supplies are dispensed; and\n(d) The  legend drug or supplies needed to administer a legend drug are\nprescribed by a  physician, advanced  practice registered nurse, or\nphysician assistant and dispensed by a pharmacist.\n(2) No  legend drug or supplies needed to administer a legend drug that are\ndonated for use under this section may be resold.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46709","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"cb6a66359157c94467d43bce65715b09138435c8d8be852efb9d090b31aff29f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.452","next":"us-ky/krs-315.456"},"notice":"GroundRules: Original legal text.
