{"data":{"id":"us-ky/krs-315.456","jurisdiction":"us-ky","citation":"KRS 315.456","heading":"Immunity from civil liability -- Exceptions.","body":"(1) Unless the manufacturer of a legend drug or supply needed to administer a\nlegend  drug exercises bad  faith or fails to exercise ordinary care, the\nmanufacturer of a legend drug or supply shall not be subject to criminal or civil\nliability for injury, death, or loss to a person or property for matters related to\nthe donation, acceptance, or dispensing of the drug or supply under the legend\ndrug repository created under KRS  315.452, including liability for failure to\ntransfer or communicate product or consumer information or the expiration date\nof the donated drug or supply.\n(2) Health facilities, pharmacies, and health care providers shall be immune  from\ncivil liability for injury to or the death of an individual to whom  a legend drug or\nsupply is dispensed and  shall not be  subject to disciplinary action for\nunprofessional conduct for their acts or omissions related to donating,\naccepting, distributing, or dispensing a legend drug or supply under KRS\n315.450 to 315.460, unless the act or omission involves reckless, wanton, or\nintentional misconduct or the act or omission results from failure to exercise\nordinary care.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46711","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"5b14d6591ec42a2af092207c356a350fc15836a735bdefb77c31436710d60d77","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.454","next":"us-ky/krs-315.458"},"notice":"GroundRules: Original legal text.
