{"data":{"id":"us-ky/krs-315.458","jurisdiction":"us-ky","citation":"KRS 315.458","heading":"Required administrative regulations.","body":"The board shall promulgate administrative regulations to establish:\n(1) The requirements for health facilities and pharmacies to accept and dispense\ndonated legend drugs or supplies needed to administer legend drugs under\nKRS  315.452 and 315.454, including all of the following:\n(a) Eligibility criteria for health facilities;\n(b) Standards and procedures for accepting, safely storing, and dispensing\ndonated legend drugs or supplies needed to administer legend drugs;\n(c) Standards  and  procedures for inspecting donated legend drugs or\nsupplies needed to administer legend drugs to determine if these are in\ntheir original, unopened, sealed, and tamper-evident unit dose packaging\nor, if packaged in single-unit doses, the single-unit dose packaging is\nunopened; and\n(d) Standards  and  procedures for inspecting donated legend drugs or\nsupplies needed to administer legend drugs to determine that these are\nnot adulterated or misbranded;\n(2) Eligibility criteria for individuals to receive donated legend drugs or supplies\nneeded  to administer legend drugs dispensed under KRS  315.452 and\n315.454;\n(3) Standards for prioritizing the dispensation to individuals who are uninsured or\nindigent, or to others if an uninsured or indigent individual is unavailable;\n(4) A  means  by which an individual who is eligible to receive a donated legend\ndrug  or supplies needed  to administer a legend drug may  indicate that\neligibility;\n(5) Necessary forms for administration of the legend drug repository program;\n(6) The  maximum  handling fee that a health facility may  charge for accepting,\ndistributing, or dispensing donated legend drugs or supplies needed  to\nadminister legend drugs;\n(7) A list of legend drugs and supplies needed to administer legend drugs that the\nlegend drug repository program may accept for dispensing; and\n(8) A list of legend drugs and supplies needed to administer legend drugs that the\nlegend drug repository program shall not accept for dispensing, including the\nreason why the legend drug or supply is ineligible for donation.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46713","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"4b1d8715873504004cde8f343eb48e24665797e8014f075f4e6895861f26a25d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.456","next":"us-ky/krs-315.460"},"notice":"GroundRules: Original legal text.
