{"data":{"id":"us-ky/krs-315.500","jurisdiction":"us-ky","citation":"KRS 315.500","heading":"Emergency  authority for pharmacists during state of emergency  --","body":"Executive order -- Time limit -- Actions authorized -- Extension.\n(1) When  the Governor declares a state of emergency pursuant to KRS  39A.100,\nthe Governor may issue an executive order for a period of up to thirty (30) days\ngiving pharmacists emergency authority. The executive order shall designate\nthe geographical area to which it applies. In the executive order, the Governor\nmay  vest pharmacists with the authority to:\n(a) Dispense up to a thirty (30) day emergency supply of medication;\n(b) Administer immunizations to children pursuant to protocols established by\nthe Centers for Disease Control and Prevention, the National Institutes of\nHealth, or the National Advisory Committee on Immunization Practices or\ndetermined to be appropriate by the commissioner of public health or his\nor her designee;\n(c) Operate  temporarily, a pharmacy  in an area not designated on the\npharmacy permit; and\n(d) Dispense drugs as needed to prevent or treat the disease or ailment\nresponsible for the emergency pursuant to protocols established by the\nCenters for Disease Control and Prevention or the National Institutes of\nHealth or determined to be appropriate by the commissioner of public\nhealth or his or her designee to respond to the circumstances causing the\nemergency.\n(2) The provisions of this section may be extended, in writing, by the Governor if\nnecessary to protect the lives or welfare of the citizens.\n(3) Nothing in this section shall be affected by the requirements of KRS 39A.090.","path":["KRS Chapter 315"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50623","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"f1613bd07a29206c08a8b20ce987ad51fd1a8438ad89c90bc50d102cfee0f077","source_id":"us-ky","stale":false,"prev":"us-ky/krs-315.460","next":"us-ky/krs-315.505"},"notice":"GroundRules: Original legal text.
