{"data":{"id":"us-ky/krs-316.030","jurisdiction":"us-ky","citation":"KRS 316.030","heading":"Embalmer's license -- Qualifications -- Funeral director's license --","body":"Qualifications -- Restriction on place of practice -- Apprenticeship.\n(1) No person shall engage in, or attempt to engage in, embalming or funeral directing\nin the Commonwe alth of Kentucky unless the person is licensed under the\nprovisions of this chapter.\n(2) All Kentucky -licensed persons who practice embalming or funeral directing in\nKentucky shall practice from a funeral establishment that is licensed to operate\nunder the provisions of this chapter.\n(3) One (1) member of every firm, and one (1) officer and one (1) stockholder of every\ncorporation, that engages in embalming and funeral directing in Kentucky, shall be\na Kentucky-licensed embalmer and a Kentucky-licensed funeral director.\n(4) The board shall issue an embalmer's license to an applicant who:\n(a) Is at least eighteen (18) years of age;\n(b) Is of good moral character;\n(c) Possesses a high school diploma or a High School Equivalency Diploma;\n(d) Has received an ass ociate degree in funeral services from a college or\nuniversity accredited by the American Board of Funeral Service Education;\n(e) Has served an apprenticeship of one (1) year in a Kentucky funeral\nestablishment under the supervision of a Kentucky-licensed embalmer;\n(f) Has taken an active part during the apprenticeship in assisting with the\nembalming of at least twenty -five (25) dead human bodies under the direct\nsupervision of a Kentucky-licensed embalmer;\n(g) Has paid to the board an examination fee as se t out in administrative\nregulations promulgated by the board; and\n(h) Has passed an examination prepared or approved by the board.\n(5) The board shall issue a funeral director's license to an applicant who:\n(a) Is at least eighteen (18) years of age;\n(b) Is of good moral character;\n(c) Possesses a high school diploma or a High School Equivalency Diploma;\n(d) Has served an apprenticeship of three (3) consecutive years in a Kentucky\nfuneral establishment under the supervision of a Kentucky -licensed funeral\ndirector. An associate degree in funeral services from a college or university\naccredited by the American Board of Funeral Service Education shall\nsubstitute for two (2) years of the apprenticeship. The completion of thirty\n(30) semester credit hours or the  equivalent from an accredited college or\nuniversity shall substitute for one (1) year of the apprenticeship. At no time\nshall more than two (2) years of the apprenticeship be substituted;\n(e) Has taken an active part during the apprenticeship in assisting  with the\nmanagement of at least twenty -five (25) funerals under the direct supervision\nof a Kentucky-licensed funeral director;\n(f) Has paid to the board an examination fee as set out in administrative\nregulations promulgated by the board; and\n(g) Has passed an examination prepared or approved by the board.\n(6) An applicant may serve embalming and funeral directing apprenticeships\nconcurrently.\n(7) At the beginning of an apprenticeship, an applicant for an embalmer's or a funeral\ndirector's license shall:\n(a) Appear before the board;\n(b) Pay to the board a registration fee as set out in administrative regulations\npromulgated by the board; and\n(c) File with the board the sworn statement of the supervising Kentucky -licensed\nembalmer or the Kentucky-licensed funeral director averring that the applicant\nwill work full -time under supervision in the funeral establishment and will\nreceive a regular salary.\n(8) An applicant shall work full -time in the funeral establishment during the\napprenticeship and shall receive a regular salary.\n(9) An applicant shall file with the board semiannually during the apprenticeship sworn\nstatements by the applicant and the supervising Kentucky -licensed embalmer or\nKentucky-licensed funeral director setting out the number of hours work ed, the\nnumber of embalmings or funerals in which the applicant has assisted, and the\nsalary received.\n(10) A Kentucky -licensed embalmer or a Kentucky -licensed funeral director shall not\nsupervise more than five (5) applicants serving apprenticeships at any one (1) time.","path":["KRS Chapter 316"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50922","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"ff636c2c69a8d4790d7bc86dea688480b2b433d3803f0c8110cda96b86cac1b9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-316.020","next":"us-ky/krs-316.040"},"notice":"GroundRules: Original legal text.
