{"data":{"id":"us-ky/krs-316.150","jurisdiction":"us-ky","citation":"KRS 316.150","heading":"Nonissuance, nonrenewal, revocation, suspension, and probation of","body":"licenses.\n(1) The board may refuse to issue or renew, may revoke, or suspend and impose\nprobationary conditions on the license of any Kentucky-licensed embalmer or\nKentucky-licensed funeral director, and may  issue a written reprimand and\nimpose a fine, for:\n(a) Violating any provision of this chapter, any lawful order of the board, or\nany administrative regulation promulgated by the board pursuant to this\nchapter;\n(b) Being convicted of any felony, or any misdemeanor if the misdemeanor\nrelates to the practice of embalming or funeral directing, if in accordance\nwith KRS  Chapter 335B. For purposes of this subsection, a conviction\nincludes a finding or verdict of guilt or an entry of a guilty plea or a plea of\nno contest;\n(c) Paying or offering to pay, directly or indirectly, any consideration of value\nto secure a funeral, prior to or after an individual's death, or allowing the\napplicant's or licensee's employee or immediate family member  to pay\nanything of value to secure a funeral;\n(d) Soliciting business in any way by offering or giving any service which is\nnot a normal function of a licensed embalmer  or a licensed funeral\ndirector in a regular service;\n(e) Permitting any person who  is not a Kentucky-licensed embalmer  or\nKentucky-licensed funeral director to perform any service pertaining to\nembalming or funeral directing required by law of a licensed embalmer or\na licensed funeral director, from the time of death until interment;\n(f) Misrepresenting or concealing a material fact in obtaining a license or an\napprentice registration;\n(g) Assisting any applicant for an embalmer's or a funeral director's license in\nobtaining the license by misrepresentation or concealment of a material\nfact in registering for an apprenticeship, or during the period of serving an\napprenticeship, or in taking or passing the examination for an embalmer's\nor a funeral director's license;\n(h) Being  sanctioned for a violation of any state or federal statute or\nadministrative regulation governing the funeral industry or its practice for\nwhich a plan of correction or remedial action was not accepted by the\nstate or federal authority; or\n(i) Committing  any  act which  constitutes unprofessional, fraudulent,\nmisleading, corrupt, deceptive, or dishonest conduct. If the act constitutes\na  crime, conviction in a criminal proceeding shall not be a condition\nprecedent to a disciplinary action.\n(2) The  board may  refuse to issue, may  revoke, or suspend  and  impose\nprobationary conditions on the registration of an apprentice, and may issue a\nwritten reprimand and impose a fine, for:\n(a) Violating any of the provisions set out in paragraphs (a) to (i) of\nsubsection (1) of this section; or\n(b) Disobeying the proper orders or instructions of a superior.\n(3) The board may refuse to issue or renew, may revoke, or suspend and impose\nprobationary conditions on the license of any funeral establishment, and may\nissue a written reprimand and impose a fine, for:\n(a) Misrepresenting or concealing a material fact in obtaining a funeral\nestablishment license;\n(b) Operating a funeral establishment in violation of any lawful order of the\nboard  or any  state or federal statute or administrative regulation\ngoverning the operation of a funeral establishment; or\n(c) Operating  a  funeral establishment without the supervision of a\nKentucky-licensed embalmer or a Kentucky-licensed funeral director.","path":["KRS Chapter 316"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46817","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:12Z","sha256":"83c39e59976005566b34e76660b60b949e8258e525bbabe3160b61a2cb2366da","source_id":"us-ky","stale":false,"prev":"us-ky/krs-316.140","next":"us-ky/krs-316.155"},"notice":"GroundRules: Original legal text.
