{"data":{"id":"us-ky/krs-317.420","jurisdiction":"us-ky","citation":"KRS 317.420","heading":"Barber license requirements -- Exemptions -- Advertising.","body":"(1) No person shall engage in the practice of \"barbering\" for other than cosmetic\npurposes nor shall any person engage in barbering for the treatment of physical or\nmental ailments, except that the provisions of this chapter shall not apply to:\n(a) Persons authorized by the law of this state to practice medicine, chiropody,\noptometry, dentistry, chiropractic, nursing, or embalming when incidental\npractices of barbering are performed b y them in the normal course of the\npractice of their profession;\n(b) Commissioned medical or surgical personnel of the United States Armed\nForces performing incidental practices of barbering in the course of their\nduties; or\n(c) Barbering services performed at an institution operated by or under contract to\nthe Department of Corrections or the Department of Juvenile Justice.\n(2) Except as provided in subsection (1) of this section, no person shall engage in the\npractice of barbering for the public generally  or for consideration without the\nappropriate license required by this chapter.\n(3) No person, unless duly and properly licensed pursuant to this chapter, shall:\n(a) Teach barbering;\n(b) Operate a barber shop or mobile barber shop;\n(c) Conduct or operate a school for barbers;\n(d) Lease or rent booth space as an independent contract owner; or\n(e) Operate a mobile barber shop without first notifying the board of its location\nor change in its location.\n(4) No person shall aid or abet any person in violating the provisions of this section,\nnor shall any person engage or employ for consideration any pe rson for the\nperformance of any practice licensed by this chapter unless the person to perform\nsuch practice holds and displays the appropriate license therefor.\n(5) Except as provided in this chapter, no person or business shall:\n(a) Advertise barbering services, unless the person or business and the personnel\nit employs are licensed under this chapter;\n(b) Advertise as a barber shop or mobile barber shop, unless all persons in the\nshop practicing barbering services are licensed under this chapter. Any bar ber\npracticing in a shop licensed as both a barber shop and a salon licensed under\nKRS Chapter 317A may display an image, that is at least four (4) inches high,\nof a barber pole at his or her station; or\n(c) Use or display a barber pole for the purpose of advertising barbering services\nto the public unless it:\n1. Has a barber shop license; and\n2. Employs a barber licensed under this chapter.\n(6) A person holding an active barber license from the board and who practices in a\nshop licensed by the board may render services for pay or otherwise to:\n(a) A person suffering from a terminal illness who is receiving the services of a\nhospice program either at home or at a hospice inpatient unit; or\n(b) A person who is deceased and in the care of a funeral establishment.","path":["KRS Chapter 317"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56216","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:13Z","sha256":"b036b8b906d1eeb539de3f7048f3f9bc63eba58c245516fd12bda10196cae258","source_id":"us-ky","stale":false,"prev":"us-ky/krs-317.410","next":"us-ky/krs-317.430"},"notice":"GroundRules: Original legal text.
