{"data":{"id":"us-ky/krs-319.015","jurisdiction":"us-ky","citation":"KRS 319.015","heading":"Activities not included in practice of psychology.","body":"Nothing in this chapter shall be construed to limit:\n(1) The activities, services, and use of title on the part of a person in the employ of the\nfederal government;\n(2) Persons from engaging in the teaching of psychology, the conduct of psychological\nresearch, the provision of consultation services to organizations or institutions, or\nthe provision of expert testimony, provided that such activities do not involve the\ndelivery or supervision of direct psychological services to individuals or groups;\n(3) Persons licensed, certified, or registered under any other provision of the Kentucky\nRevised Statutes from rendering services consistent with the laws regulating their\nprofessional practice and the ethics of their profession. The use of written or\ncomputerized interpretations of any psychological testing or the administration and\nuse of symptomatic and behavioral assessments by a practitioner of the healing arts\nas defined in KRS 311.271(2), clinical social worker, marriage and family therapist,\nprofessional ar t therapist, advanced practice registered nurse, physician, physical\ntherapist, or occupational therapist who uses these interpretations or administers and\nuses these assessments shall not be limited. They shall not represent themselves to\nbe psychologists or use the term \"psychological\" in describing their services;\n(4) The activities of a student, intern, or resident in psychology, pursuing a course of\nstudy approved by the department of psychology of an educational institution rated\nacceptable by the boa rd for qualifying training and experience, provided such\nactivities are recognized by transcript as a part of his or her supervised course of\nstudy;\n(5) The recognized educational activities of teachers in accredited public and private\nschools, the authori zed duties of guidance counselors who are certified by the\nEducation Professional Standards Board, or the activities of persons using\npsychological techniques in business and industrial organizations for employment\nplacement, promotion, or job adjustment of their own officers and employees;\n(6) Persons who are credentialed as school psychologists by the Education Professional\nStandards Board from using the title \"school psychologist\" and practicing\npsychology as defined in KRS 319.010, if their practice is restricted to regular\nemployment within a setting under the purview of the Education Professional\nStandards Board. These individuals shall be employees of the educational\ninstitution and not independent contractors providing psychological services to\neducational institutions;\n(7) A duly ordained minister, priest, rabbi, Christian Science practitioner, or other\nclergyman from carrying out his or her responsibilities while functioning in a\nministerial capacity within a recognized religious organization servin g the spiritual\nneeds of its constituency, if he or she does not hold himself or herself out as a\npsychologist; or\n(8) Any nonresident temporarily employed in this state from rendering psychological\nservices for not more than thirty (30) days every two (2)  years, if he or she holds a\nvalid current license or certificate as a psychologist in his or her home state or\ncountry and registers with the board prior to commencing practice in the\nCommonwealth or if he or she holds a valid current IPC.","path":["KRS Chapter 319"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31221","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:14Z","sha256":"d0fcedf6d23fcfeebf4e63a69f2c3929359b61c8e0a3fe3afba78b347d47c071","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319.010","next":"us-ky/krs-319.020"},"notice":"GroundRules: Original legal text.
