{"data":{"id":"us-ky/krs-319.045","jurisdiction":"us-ky","citation":"KRS 319.045","heading":"National and state criminal background investigation requirement.","body":"(1) The board shall require a national and state criminal background investigation for\nevery:\n(a) Applicant seeking an initial license issued by the board permitting the\napplicant to engage in a profession authorized by the board;\n(b) Applicant seeking to reinstate a license; and\n(c) Kentucky credential holder who applies for authorization to engage in the\npractice of psychology outside this Commonwealth in accordance with the\nIPC.\n(2) The criminal background investigation under subsection (1) of this section shall be\nby means of a fingerprint check by the Department of Kentucky State Police and\nFederal Bureau of Investigation pursuant to the following requirements:\n(a) The board  shall require each applicant described in subsection (1) of this\nsection to provide a complete and legible set of fingerprints to the Department\nof Kentucky State Police for submission to the Federal Bureau of\nInvestigation for a national criminal backgro und check after a state criminal\nbackground check is conducted;\n(b) The results of the national and state criminal background check shall be sent\nto the board for the screening of applicants;\n(c) The results of a national and state criminal background chec k shall not be\ndistributed or otherwise released by the board, except that the board:\n1. Shall provide any applicant or credential holder the results of his or her\nnational and state criminal background check upon request; and\n2. May introduce the results under seal as evidence in a legal proceeding\nthat involves a challenge to any disciplinary action taken by the board\nbased in whole or in part on information contained in the results; and\n(d) Any fee charged by the Department of K entucky State Police or for the\nFederal Bureau of Investigation background check shall be an amount no\ngreater than the actual cost of processing the request and conducting the\nbackground check.\n(3) The board shall review the criminal background check resu lts for every person\ndescribed in subsection (1)(c) of this section and determine whether the person is\neligible to apply for the compact privilege to practice outside the Commonwealth.\n(4) The board may require a criminal background check for any credenti al holder who\nis the subject of a grievance alleging misconduct by the credential holder as\ndescribed in KRS 319.082.\n(5) Unless otherwise required by law, the board shall not require a criminal background\ncheck solely for the purpose of renewing a license.\n(6) The board shall promulgate administrative regulations in accordance with KRS\nChapter 13A to implement this section.","path":["KRS Chapter 319"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57169","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:14Z","sha256":"429101ea9a9c3c664c7b99c5f6fdb48e2e0393b87c639f78480ef29924117e04","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319.040","next":"us-ky/krs-319.050"},"notice":"GroundRules: Original legal text.
