{"data":{"id":"us-ky/krs-319.118","jurisdiction":"us-ky","citation":"KRS 319.118","heading":"Immunity of board members from liability -- Standing to institute and","body":"maintain legal actions -- Effect of surrender of license or certificate --\nRepresentation of board by public officers.\n(1) Members of the board, its agents, and employees shall be i mmune from personal\nliability in any action, civil or criminal, which is based upon any official act or acts\nperformed by them in good faith.\n(2) Notwithstanding the existence or pursuit of any other remedy, civil or criminal, the\nboard may institute and m aintain actions to restrain or enjoin any violation of this\nchapter, rules and administrative regulations, or order of the board.\n(3) The surrender of a license shall not serve to deprive the board of jurisdiction to\nproceed with disciplinary actions pursuant to this chapter.\n(4) The city, county, Commonwealth's attorney, and the Attorney General shall, within\ntheir respective jurisdictions and within their legal discretion, represent the board,\nits agents, and employees, in the enforcement of the provision s of this chapter and\nthe rules and administrative regulations of the board.","path":["KRS Chapter 319"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31248","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"f470956f8e7f79d0dfba8dd7acf205666cd57cbbc6ea920a3b0845b3c3ba3151","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319.111","next":"us-ky/krs-319.120"},"notice":"GroundRules: Original legal text.
