{"data":{"id":"us-ky/krs-319a.010","jurisdiction":"us-ky","citation":"KRS 319A.010","heading":"Definitions for chapter.","body":"As used in this chapter:\n(1) \"Board\" means the Kentucky Board of Licensure for Occupational Therapy\nappointed by the Governor;\n(2) \"Practice of occupational therapy\" means the therapeutic use of purposeful and\nmeaningful occupations (goal -directed activities) to evaluate and treat ind ividuals\nwho have a disease or disorder, impairment, activity limitation, or participation\nrestriction that interferes with their ability to function independently in daily life\nroles, and to promote health and wellness. Occupational therapy intervention m ay\ninclude:\n(a) Remediation or restoration, through goal -directed activities, of those\nperformance abilities that are limited due to impairment in biological,\nphysiological, or neurological processes;\n(b) Adaptation of task, process, or the environment or the teaching of\ncompensatory techniques to enhance performance;\n(c) Disability prevention methods and techniques that facilitate the development\nor safe application of performance skills; and\n(d) Health promotion strategies and practices that enhance performance abilities;\n(3) \"Occupational therapist\" means a person licensed to practice occupational therapy\nunder this chapter;\n(4) \"Occupational therapy assistant\" means a person licensed to assist in the practice of\noccupational therapy under this chapter, w ho works under the supervision of an\noccupational therapist;\n(5) \"Aide\" means a person who is not licensed by the board who provides supportive\nservices to occupational therapists and occupational therapy assistants. An aide shall\nfunction under the guidan ce and responsibility of a licensed occupational therapist\nand is supervised by an occupational therapist or an occupational therapy assistant\nfor specifically selected routine tasks for which the aide has been trained and has\ndemonstrated competence. The aide shall comply with supervision requirements\ndeveloped by the board that are consistent with prevailing professional standards;\n(6) \"Occupational therapy services\" include but are not limited to:\n(a) Evaluating, developing, improving, sustaining, or res toring skills in basic and\ninstrumental activities of daily living (BADLs and IADLs), work or\nproductive activities, and play and leisure activities;\n(b) Evaluating, developing, remediating, or restoring components of performance\nas they relate to sensorimotor, cognitive, or psychosocial aspects;\n(c) Designing, fabricating, applying, and training in the use of assistive\ntechnology or orthotic devices and training in the use of prosthetic devices for\nfunctional mobility and activities of daily living;\n(d) Adapting environments and processes, including the application of ergonomic\nprinciples, to enhance performance and safety in daily life roles;\n(e) Applying superficial physical agent modalities as an adjunct to or in\npreparation for engagement in occupations;\n(f) Applying deep physical agent modalities as an adjunct to or in preparation for\nengagement in occupations, in accordance with KRS 319A.080;\n(g) Evaluating and providing intervention in collaboration with the client, family,\ncaregiver, or others;\n(h) Educating the client, family, caregiver, or others in carrying out appropriate\nnonskilled interventions; and\n(i) Consulting with groups, programs, organizations, or communities to provide\npopulation-based services;\n(7) \"Person\" means any individual, partn ership, or unincorporated organization, or\ncorporation;\n(8) \"Deep physical agent modalities\" means any device that uses sound waves or agents\nwhich supply or induce an electric current through the body, which make the body a\npart of the circuit, including iontophoresis units with a physician's prescription,\nultrasound, transcutaneous electrical nerve stimulation units and functional\nelectrical stimulation, or microcurrent devices; and\n(9) \"Superficial physical agent modalities\" means hot packs, cold packs, ice,\nfluidotherapy, paraffin, water, and other commercially available superficial heating\nand cooling devices.","path":["KRS Chapter 319A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31254","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"d77dfa5fc06f3cc445928ca32bff16cd01e42932d34080739d123ead05094e84","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319.990","next":"us-ky/krs-319a.020"},"notice":"GroundRules: Original legal text.
