{"data":{"id":"us-ky/krs-319a.070","jurisdiction":"us-ky","citation":"KRS 319A.070","heading":"Powers and duties of board.","body":"(1) The board shall administer and enforce the provisions of this chapter and shall have\nthe responsibility of evaluating the qualifications of applicants for licensure.\n(2) The board may issue subpoenas, examine witnesses, administer oaths, and\ninvestigate allegations of practices violating the provisions of this chapter.\n(3) The board may:\n(a) Promulgate administrative regulations, pursuant to KRS Chapter 13A, relating\nto professional conduct to carry out the provisions of this chapter, including\nbut not limi ted to administrative regulations relating to professional licensure\nand holding a license to practice occupational therapy or assist in the practice\nof occupational therapy in the Commonwealth;\n(b) Conduct administrative hearings in accordance with KRS Chapter 13B;\n(c) Evaluate the qualifications and authorize the issuance of licenses to qualified\noccupational therapists and occupational therapy assistants;\n(d) Issue and renew licenses based on evidence of initial and continued\ncompetence of persons subject to this chapter;\n(e) Suspend or revoke licenses;\n(f) Require the continuing professional education of persons subject to this\nchapter;\n(g) Keep a record of its proceedings and a register of all persons licensed as\noccupational therapists or occupational therapy assistants. The register shall\nshow the name of every licensee, the licensee's last known place of business\nand last known place of residence, and the date and number of the license of\neach licensed occupational therapist or occupational therapy as sistant. The\nboard shall, during the month of January of every year, compile and make\navailable a list of licensed occupational therapists and occupational therapy\nassistants authorized to practice in the Commonwealth. Any citizen of the\nCommonwealth may o btain a copy of the list upon application to the board\nand payment of an amount to be fixed by the board, which shall not exceed its\ncost;\n(h) Make an annual report to the Governor and the General Assembly which shall\ncontain an account of duties performed , actions taken, and appropriate\nrecommendations;\n(i) Institute and maintain actions to restrain or enjoin any violation of this chapter\nand administrative regulations notwithstanding the existence or pursuit of\nother civil or criminal penalties;\n(j) Approve an examination for occupational therapists and occupational therapy\nassistants and establish standards for acceptable performance;\n(k) Seek an injunction in Franklin Circuit Court against any individual who\npractices occupational therapy in the Commonwealth without a license; and\n(l) Promulgate administrative regulations to define appropriate supervision of\nassistants, aides, and unlicensed personnel that are delivering occupational\ntherapy services.","path":["KRS Chapter 319A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31260","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"0c47d05a0dcdb69fd03171d73fd94984aa4b57dc9de0e769df708dd4d1259a54","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319a.060","next":"us-ky/krs-319a.075"},"notice":"GroundRules: Original legal text.
