{"data":{"id":"us-ky/krs-319a.080","jurisdiction":"us-ky","citation":"KRS 319A.080","heading":"License required for practice of occupational therapy or use of title","body":"\"occupational therapist\" -- Training requirements for use of deep physical\nagent modalities.\n(1) It shall be unlawful for any person to practice occupational therapy, assist in the\npractice of occupational therapy, or render services designated as occupational\ntherapy in the Commonwealth of Kentucky, unless licensed under the provisions of\nthis chapter.\n(2) The licensure of occupational therapists and occupational therapy assistants  shall\nextend only to individuals. A license shall not be issued to a partnership,\nunincorporated association, corporation, or similar business organization.\n(3) It shall be unlawful for a person to act or represent himself or herself as an\noccupational therapist or occupational therapy assistant, use the title \"occupational\ntherapist\" or \"occupational therapy assistant,\" or use the letters OT or OTA or any\nabbreviation or acronym that would imply licensing under this chapter, unless the\nperson is licensed and is in good standing in accordance with the requirements of\nthis chapter. A person, health care institution, health care service, health plan, or\nother entity holding itself out to the public as providing occupational therapy\nservices shall not use the title unless the occupational therapy services are provided\nby a person licensed under this chapter.\n(4) (a) It shall be unlawful for a person licensed under this chapter to utilize\noccupational therapy interventions involving deep physical agent modalitie s,\nunless the following requirements are met:\n1. The person is an occupational therapist licensed under this chapter who\nhas successfully completed a minimum of thirty -six (36) hours of\ntraining or instruction that meets the requirements specified in\nadministrative regulations promulgated by the board, as well as five (5)\ntreatments under supervision;\n2. The person is an occupational therapist licensed under this chapter who\nhas successfully completed the certified hand therapist examination\napproved by the Hand Therapy Certification Commission, and who has\nsuccessfully completed a minimum of twelve (12) hours of training or\ninstruction that meets the requirements specified in administrative\nregulations promulgated by the board, as well as five (5) treatment s\nunder supervision; or\n3. The person is an occupational therapy assistant licensed under this\nchapter who has successfully completed a minimum of seventy -two (72)\nhours of training or instruction that meets the requirements specified in\nadministrative regulations promulgated by the board, as well as five (5)\ntreatments under supervision.\n(b) The board shall promulgate administrative regulations setting forth content\nguidelines for the training and instruction required in this subsection.\nGuidelines shall b e based on policies and positions adopted by the American\nOccupational Therapy Association.","path":["KRS Chapter 319A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31261","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"40e1c31c4ec5829a72d1d5a9f564df502f0a320a310292e81c1f1b344be7bf23","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319a.075","next":"us-ky/krs-319a.090"},"notice":"GroundRules: Original legal text.
