{"data":{"id":"us-ky/krs-319a.090","jurisdiction":"us-ky","citation":"KRS 319A.090","heading":"Construction of chapter.","body":"(1) The provisions of this chapter shall not be construed as preventing or restricting the\npractices, services, or activities of:\n(a) A person licensed in accordance with the provisions of another law of the\nCommonwealth from engaging in the profession or occu pation for which\nlicensed;\n(b) A person employed as an occupational therapist or an occupational therapy\nassistant by the United States government, provided that person provides\noccupational therapy solely under the direction or control of the organization\nby which the person is employed;\n(c) A person pursuing a course of study leading to a degree or certificate in\noccupational therapy at an accredited or approved educational program,\nprovided the activities and services are part of a supervised course of s tudy\nand the person is designated by a title which clearly indicates the status of\nstudent or trainee and not licensed occupational therapist or occupational\ntherapy assistant;\n(d) A person fulfilling the supervised fieldwork experience requirements of thi s\nchapter, provided such activities and services constitute a part of the\nexperience necessary to meet the requirements of that program;\n(e) Any person performing occupational therapy services in the Commonwealth,\nif these services are performed for no mor e than sixty (60) days in a calendar\nyear in association with an occupational therapist licensed under this chapter,\nprovided that:\n1. The person is licensed under the law of another state which has licensure\nrequirements at least as stringent as the requirements of this chapter; or\n2. The person meets the requirements for current certification as an\noccupational therapist or an occupational therapy assistant, as\nestablished by the National Board for Certification in Occupational\nTherapy or its equivalent; or\n(f) Any person employed as an occupational therapy aide.\n(2) Occupational therapy services shall not include gait training, spinal or pelvic\nadjustment or manipulation, and the use of deep physical agent modalities, except\nas provided in KRS 319A.080.\n(3) Occupational therapy services shall also not include independent diagnostic\nevaluation for the determination of visually related rehabilitative treatment plans or\nthe testing and prescription of optical, electronic, or assistive technology low -vision\ndevices. Occupational therapists may only provide low -vision or visual therapy\nservices, as defined in administrative regulation, under the direct supervision of an\noptometrist, ophthalmologist, or physician, or by written prescription from an\noptometrist, o phthalmologist, or physician. These services shall be provided in\naccordance with a written evaluation and clinical treatment plan from an\noptometrist, ophthalmologist, or physician.
