{"data":{"id":"us-ky/krs-319a.190","jurisdiction":"us-ky","citation":"KRS 319A.190","heading":"Unprofessional conduct -- Denial, refusal to renew, suspension,","body":"revocation, or imposition of probationary conditions upon a license.\n(1) The board may deny or refuse to renew a license, may suspend or revoke a license,\nor may impose probationary conditions where the licensee or applicant for licensure\nhas engaged in unprofessional conduct which has endangered or is likely to\nendanger the health, welfare, or safety of the public. Unprofessional conduct shall\ninclude:\n(a) Obtaining a license by m eans of fraud, misrepresentation, or concealment of\nmaterial facts;\n(b) Unprofessional conduct as defined by administrative regulations promulgated\nby the board, or violating the code of ethics promulgated by the board;\n(c) Being convicted of a felony in a ny court if the act or acts for which he was\nconvicted are found by the board to have a direct bearing on whether he\nshould be entrusted to serve the public in the capacity of a licensed\noccupational therapist or licensed occupational therapy assistant, if  in\naccordance with KRS Chapter 335B;\n(d) Violating any lawful order or administrative regulation rendered or\npromulgated by the board;\n(e) Violating any provision of this chapter;\n(f) Violating KRS 304.39-215; or\n(g) Engaging in conduct that is subject to  the penalties under KRS 304.99 -060(4)\nor (5).\n(2) A denial, refusal to renew, suspension, revocation, or imposition of probationary\nconditions upon a license may be ordered by the board in a decision made after an\nadministrative hearing conducted in accor dance with KRS Chapter 13B and\nadministrative regulations promulgated by the board. The board shall have\ndiscretion to accept or reject an application for reinstatement following an\nadministrative hearing conducted in accordance with KRS Chapter 13B.\n(3) The surrender of a license shall not serve to deprive the board of jurisdiction to\nproceed with disciplinary actions under this chapter.","path":["KRS Chapter 319A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49065","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"376bff9b13de14c0c21953500a77d8f6a88923954683b7b586948fe4189ff233","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319a.180","next":"us-ky/krs-319a.200"},"notice":"GroundRules: Original legal text.
