{"data":{"id":"us-ky/krs-319b.010","jurisdiction":"us-ky","citation":"KRS 319B.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context requires otherwise:\n(1) \"Board\" means the Kentucky Board of Prosthetics, Orthotics, and Pedorthics;\n(2) \"CAAHEP\" means the Commission on Accreditation of Allied Health Education\nPrograms;\n(3) \"Custom fabricated a nd fitted device\" means an orthosis, prosthesis, or pedorthic\ndevice that is fabricated to original measurements, or to a mold for use by a patient\nin accordance with a prescription from a health care practitioner or provider\nauthorized by law to write suc h prescriptions, and that requires substantial clinical\nand technical judgment in its design and fitting;\n(4) \"Custom fitted device\" means a prefabricated orthosis, prosthesis, or pedorthic\ndevice sized or modified for use by the patient in accordance with  a prescription\nfrom a health care practitioner or provider authorized by law to write such\nprescriptions that requires substantial clinical judgment and substantive alteration\nfor appropriate use;\n(5) \"Facility\" means the business location where orthotic,  prosthetic, or pedorthic care\nis provided. The orthotic/prosthetic/pedorthic facility has the appropriate clinical\nand laboratory space and equipment to provide comprehensive orthotic, prosthetic,\nand pedorthic care. Licensed orthotists, prosthetists, and  pedorthists shall be\navailable to either provide care or to supervise the provision of care by nonlicensed\nstaff;\n(6) \"Licensed orthotic fitter\" means a person who receives a license under this chapter\nto fit the following noncustom orthotic devices:\n(a) Cervical orthoses, except those requiring more than minor modification or\nthose used to treat an unstable cervical condition;\n(b) Pressure gradient hose;\n(c) Trusses;\n(d) Prefabricated spinal orthoses, except those used in the treatment of scoliosis\nor uns table spinal conditions, rigid body jackets made of thermoformable\nmaterials, and \"halo\" devices; and\n(e) Prefabricated orthoses of upper and lower extremities, except those used in\nthe treatment of bone fractures and dislocations, therapeutic (diabetic) s hoes\nor inserts, and functional electrical stimulation orthoses, such as myo -orthosis\nor neuroprosthesis;\n(7) \"Licensed orthotist\" means a person who is licensed under this chapter to practice\northotics and who represents the person to the public by title or description of\nservices that includes the term \"orthotic,\" \"orthotist,\" \"brace,\" or a similar title or\ndescription of services;\n(8) \"Licensed pedorthist\" means a person who is licensed under this chapter to practice\npedorthics and who represents the person to the public by the title or description of\nservices that includes the term \"pedorthic,\" \"pedorthist,\" or a similar title or\ndescription of services;\n(9) \"Licensed prosthetist\" means a person who is licensed under this chapter to practice\nprosthetics and who represents the person to the public by title or description of\nservices that includes the term \"prosthetic,\" \"prosthetist,\" \"ar tificial limb,\" or a\nsimilar title or description of services;\n(10) \"NCOPE\" means the National Commission on Orthotic and Prosthetic Education;\n(11) \"Orthosis\" means a custom -designed, fabricated, fitted, or modified device to\ncorrect, support, or compensa te for a neuro -musculoskeletal disorder or acquired\ncondition. \"Orthosis\" does not include fabric or elastic supports, corsets, arch\nsupports, low-temperature plastic splints, trusses, elastic hoses, canes, crutches, soft\ncervical collars, dental appliance s, or other similar devices that are carried in stock\nand sold without modification as \"over -the-counter\" items by a pharmacy,\ndepartment store, corset shop, or surgical supply facility;\n(12) \"Orthotic and prosthetic education program\" means a course of in struction\naccredited by CAAHEP, consisting of:\n(a) An adequate curriculum of college level training and instruction in math,\nphysics, biology, chemistry, and psychology; and\n(b) A specific curriculum in orthotic or prosthetic courses, including:\n1. Lectures covering pertinent anatomy, biomechanics, pathomechanics,\nprosthetic-orthotic components and materials, training and functional\ncapabilities, prosthetic or orthotic performance evaluation, prescription\nconsiderations, etiology of amputations and disease processes\nnecessitating prosthetic or orthotic use, and medical management;\n2. Subject matter related to pediatric and geriatric problems;\n3. Instruction in acute care techniques, such as immediate and early\npostsurgical prosthetics and fracture-bracing techniques; and\n4. Lectures, demonstrations, and laboratory experiences related to the\nentire process of measuring, casting, fitting, fabricating, aligning, and\ncompleting prostheses or orthoses;\n(13) \"Orthotics\" means the science and practice of evaluating,  measuring, designing,\nfabricating, assembling, fitting, adjusting, or servicing an orthosis, under an order\nfrom a licensed health care practitioner or provider authorized by law to issue such\nan order, for the correction or alleviation of neuromuscular o r musculoskeletal\ndysfunction, disease, injury, or deformity;\n(14) \"Orthotist\" means a person who is specifically trained and educated to provide or\nmanage the provision of a custom -designed, fabricated, modified, and fitted\nexternal orthosis to an orthoti c patient, based on a clinical assessment and a\nprescription from a health care practitioner or provider authorized by law to write\nsuch prescriptions, to restore physiological function or cosmesis;\n(15) \"Over-the-counter device\" means a prefabricated, mas s-produced device that is\nprepackaged and requires no professional advice or judgment in either size selection\nor use, including fabric or elastic supports, corsets, generic arch supports, and\nelastic hoses;\n(16) \"Pedorthic device\" means therapeutic footwear, foot orthoses, or orthotics for use at\nthe ankle or below, below the ankle partial foot prostheses, and modified footwear\nmade for therapeutic purposes, as prescribed by a licensed health care practitioner\nor provider authorized by law to issue such a prescription. \"Pedorthic device\" does\nnot include nontherapeutic accommodative inlays or nontherapeutic accommodative\nfootwear, regardless of method of manufacture; shoe modifications made for\nnontherapeutic purposes; unmodified over -the-counter shoes; or prefabricated foot\ncare products;\n(17) \"Pedorthic education program\" means a course of instruction accredited by NCOPE,\nconsisting of:\n(a) A basic curriculum of instruction in foot -related pathology of diseases,\nanatomy, and biomechanics;\n(b) A specific curriculum in pedorthic courses, including lectures covering shoes,\nfoot orthoses, and shoe modifications, pedorthic components and materials,\ntraining and functional capabilities, pedorthic performance evaluation,\nprescription considerations, etiology of di sease processes necessitating use of\npedorthic devices, medical management, and subject matter related to\npediatric and geriatric problems; and\n(c) Lectures, demonstrations, and laboratory experiences related to the entire\nprocess of measuring and casting, fitting, fabricating, aligning, and completing\npedorthic devices;\n(18) \"Pedorthics\" means the science and practice of evaluating, measuring, designing,\nfabricating, assembling, fitting, adjusting, or servicing a pedorthic device, under an\norder from a licensed health care practitioner or provider authorized by law to issue\nsuch an order for the correction or alleviation of neuromuscular or musculoskeletal\ndysfunction, disease, injury, or deformity;\n(19) \"Pedorthist\" means a person who measures, designs, fa bricates, fits, or services\npedorthic devices and assists in the formulation of the order of pedorthic devices, as\nordered by a licensed health care practitioner or provider authorized by law to issue\nsuch an order for the support or correction of disabili ties caused by neuromuscular\nor musculoskeletal dysfunction, disease, injury, or deformity;\n(20) \"Person\" means a natural person;\n(21) \"Prosthesis\" means a custom designed, fabricated, fitted, or modified device to\nreplace an absent external limb, for the purpose of restoring physiological function\nor cosmesis. \"Prosthesis\" does not include artificial eyes or ears, dental appliances,\nartificial breasts, cosmetic devices such as artificial eyelashes or wigs, or other\ndevices that do not have a significant impact on the musculoskeletal functions of the\nbody;\n(22) \"Prosthetics\" means the science and practice of evaluating, measuring, designing,\nfabricating, assembling, fitting, adjusting, or servicing a prosthesis, under an order\nfrom a licensed health care pra ctitioner or provider authorized by law to issue such\nan order;\n(23) \"Prosthetist\" means a person who is specifically trained and educated to provide or\nmanage the provision of a custom designed, fabricated, modified, and fitted external\nlimb prosthesis to  a prosthetic patient, based on a clinical assessment and a\nprescription from a health care practitioner or provider authorized to write such\nprescriptions, to restore physiological function or cosmesis;\n(24) \"Prosthetist/Orthotist\" means a person who prac tices both disciplines of prosthetics\nand orthotics and who represents the person to the public by title or by description\nof services;\n(25) \"Resident\" means a person who has completed a CAAHEP accredited education\nprogram in orthotics, prosthetics, or both and is obtaining his or her clinical training\nin a residency accredited by NCOPE;\n(26) \"Residency\" means a minimum of a one -year NCOPE accredited program to\nacquire practical clinical training in orthotics, prosthetics, or both, in a patient care\nsetting;
