{"data":{"id":"us-ky/krs-319b.030","jurisdiction":"us-ky","citation":"KRS 319B.030","heading":"Powers and duties of board -- Administrative regulations -- Licensure","body":"and exemptions from licensure -- Examinations -- Fees -- Continuing education\n-- Enforcement -- Evaluation of applicants.\nThe board shall:\n(1) Promulgate administrative regulations to:\n(a) Establish licensure categories and issue licenses for orthotists, prosthetists,\npedorthists, and orthotic fitters;\n(b) Establish the qualifications, educational courses, curriculum, hours, and\nstandards that are prerequisite to issuance of all lev els and types of licensure\nestablished pursuant to paragraph (a) of this subsection. Any qualifications\nestablished by the board shall include the following:\n1. To qualify for a license to practice orthotics or prosthetics, a person\nshall:\na. Possess a min imum of a baccalaureate degree from an accredited\ncollege or university;\nb. Complete a CAAHEP accredited education program in orthotics,\nprosthetics, or both;\nc. Complete a residency as defined in this chapter in the discipline\nfor which a license is sought;\nd. Pass all written and practical examinations in any combination that\nis required and approved by the board; and\ne. Be qualified to practice in accordance with internationally\naccepted standards of orthotic and prosthetic care;\n2. To qualify for a license to practice pedorthics, a person shall:\na. Possess a minimum of a high school diploma or comparable\ncredential approved by the board;\nb. Complete an NCOPE-approved pedorthic education program;\nc. Pass all written and practical examinations that are required and\napproved by the board;\nd. Have a minimum of one thousand (1,000) hours of pedorthic\npatient care experience as approved by the board;\ne. Be qualified to practice in accordance with nationall y accepted\nstandards of pedorthic care;\n3. To qualify for a license to practice as an orthotic fitter, a person shall:\na. Possess a minimum of a high school diploma or comparable\ncredential approved by the board;\nb. Complete an NCOPE-approved orthotic fitter course;\nc. Pass all examinations that are required and approved by the board;\nd. Complete a minimum of one thousand (1,000) hours of experience\nin orthotic fitting as approved by the board;\ne. Be qualified to practice in accordance with nationally accep ted\nstandards of care acceptable to the board;\n4. Provisions that a person may be licensed in more than one (1) discipline;\n(c) Establish the circumstances or conditions, if any, under which persons may be\nexempt from licensure after completion of training , while waiting to take or\nreceive the results of any required examination, or upon meeting specified\nminimum educational and clinical qualifications;\n(d) Select the examination or examinations to be utilized as the board's licensure\nexamination or examina tions and the prerequisites for admission to the\nexamination or examinations. The board may enter into a contract or\nagreement with the chosen examination service or services, or select an\nintermediary between the board and the examination service or servi ces, to\nprocess applicants for the examination or examinations;\n(e) Establish any other criteria for licensure that are reasonably related to the safe\nand competent performance of prosthetics, orthotics, and pedorthics;\n(f) 1. Establish the fees to be paid for each of the following:\na. Application for licensure;\nb. Renewal or reinstatement of licensure;\nc. Late renewal of licensure;\nd. Application for continuing education course approval; and\ne. Duplicate or replacement license.\n2. The fees shall be set at a level that is adequate to pay all of the expenses\nof implementing and administering licensure under this chapter;\n(g) Establish the continuing education requirements for licensees, which shall\ninclude the frequency of reporting, number of hours, types of  courses,\napproval of courses, methods of proving compliance, penalties for violation,\nand all fees necessary for implementing the continuing education process; and\n(h) Delineate the standards of practice for persons licensed under this chapter; and\n(2) Administer and enforce the provisions of this chapter and evaluate the qualifications\nof applicants for licensure.","path":["KRS Chapter 319B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=31279","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"02bed306c15825e39f3d3e2ee77a50dcb7611e765dd7c138502a131d33967a63","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319b.020","next":"us-ky/krs-319b.040"},"notice":"GroundRules: Original legal text.
