{"data":{"id":"us-ky/krs-319b.060","jurisdiction":"us-ky","citation":"KRS 319B.060","heading":"Licensure for practice of professions governed by KRS Chapter 319B --","body":"\"Grandfather\" provisions for licensure.\n(1) On and after January 1, 2013, no person shall practice any profession governed by\nthis chapter, or hold himself or herself out as being able to practice any such\nprofession, or dispense a custom orthosis, prosthesis, or pedorthic device, unless\nthat person is licensed by the board.\n(2) (a) Until January 1, 2013, a person certified by the American Board for\nCertification in Orthotics, Prost hetics and Pedorthics, Inc. (ABC), with the\ntitle of Certified Orthotist (CO), Certified Prosthetist (CP), or Certified\nProsthetist/Orthotist (CPO), or by the Board of Certification/Accreditation,\nInternational (BOC) with the title of Board of Certification-Orthotist (BOCO),\nBoard of Certification -Prosthetist (BOCP), or Board of Certification -\nProsthetist/Orthotist (BOCPO), or holding similar certifications from other\naccrediting bodies with equivalent educational requirements and examination\nstandards, may apply for and may be granted orthotic or prosthetic licensure\nby the board, upon payment of the required fee and after the board has\ncompleted a review of the applicant's work history. The board shall complete\nits review for the purposes of this section wi thin six (6) months of the date of\napplication. The review may include but is not limited to completion by the\napplicant of a questionnaire regarding the applicant's work history and scope\nof practice.\n(b) Until January 1, 2013, an orthotist or prosthetist  certified by either the\nAmerican Board for Certification in Orthotics, Prosthetics and Pedorthics, Inc.\n(ABC), or the Board of Certification/Accreditation, International (BOC), shall\nbe held to the standards of practice enforced by the board that has certified the\northotist or prosthetist. For these purposes, certification by either board shall\nbe considered equally valid and enforceable regarding pedorthist certification\nand standards of practice.\n(c) After December 31, 2012, any applicant for licensure a s an orthotist or a\nprosthetist shall meet the requirements of this chapter regarding the applicable\nlicense.\n(3) (a) Until January 1, 2013, a person certified as a Certified Pedorthist (C.Ped) by\nthe American Board for Certification in Orthotics, Prosthet ics and Pedorthics,\nInc. (ABC), or certified as a Board of Certification -Pedorthist (BOCPD) by\nthe Board of Certification/Accreditation, International (BOC), or holding\nsimilar certifications from other accrediting bodies with equivalent\neducational requirements and examination standards, may apply for and may\nbe granted pedorthic licensure under this chapter, upon payment of the\nrequired fee and after the board has completed a review of the applicant's\nwork history. The board shall complete its review for the purposes of this\nsection within six (6) months of the date of application. The review may\ninclude but is not limited to completion by the applicant of a questionnaire\nregarding the applicant's work history and scope of practice.\n(b) Until January 1, 20 13, a pedorthist certified by either the American Board for\nCertification in Orthotics, Prosthetics and Pedorthics, Inc. (ABC), or the\nBoard of Certification/Accreditation, International (BOC), shall be held to the\nstandards of practice enforced by the boa rd that has certified the pedorthist.\nFor these purposes, certification by either board shall be considered equally\nvalid and enforceable regarding pedorthist certification and standards of\npractice.\n(c) After December 31, 2012, any applicant for licensure  as a pedorthist shall\nmeet the requirements of the board regarding licensure.\n(4) Notwithstanding any other provision of this chapter to the contrary, as an alternative\nmechanism for those in practice who are not currently certified, a person who has\npracticed full -time for a minimum of the past four (4) years in a\nprosthetic/orthotic/pedorthic facility as an orthotist, prosthetist, or pedorthist, may\nfile an application with the board before January 1, 2013, in order to continue to\npractice orthotics, prosthetics, or pedorthics, and may be issued a license to practice\northotics, prosthetics, or pedorthics by the board without examination, upon the\nboard's receipt of payment of the required licensing fee and after the board has\ncompleted a review of the app licant's work history. The board shall complete its\nreview for the purposes of this section within six (6) months of the date of\napplication. The review may include but is not limited to completion by the\napplicant of a questionnaire regarding the applican t's work history and scope of\npractice.\n(5) (a) Until January 1, 2013, a person certified as a Certified Fitter -orthotics (CFo)\nby the American Board for Certification in Orthotics, Prosthetics and\nPedorthics, Inc. (ABC), or certified as a Certified Orthotic Fitter (COF) by the\nBoard of Certification/Accreditation, International (BOC), or holding similar\ncertifications from other accrediting bodies with equivalent educational\nrequirements and examination standards, may apply for and may be granted\nlicensure as an orthotic fitter under this chapter, upon payment of the required\nfee and after the board has completed a review of the applicant's work history.\nThe board shall complete its review for the purposes of this section within six\n(6) months of the date o f application. The review may include but is not\nlimited to completion by the applicant of a questionnaire regarding the\napplicant's work history and scope of practice.\n(b) Until January 1, 2013, an orthotic fitter certified by either the American Board\nfor Certification in Orthotics, Prosthetics and Pedorthics, Inc.
