{"data":{"id":"us-ky/krs-319b.090","jurisdiction":"us-ky","citation":"KRS 319B.090","heading":"Licensed health care practitioners and other professions not to be limited","body":"or restricted by KRS Chapter 319B.\nNothing in this chapter or in the administrative regulations promulgated by the board\npursuant to this chapter shall be interpreted to limit or restrict:\n(1) A licensed health care practitioner or provider from engaging in the full scope of\npractice authorized by the license for that person's profession, training, or services;\n(2) A person licensed as a physical therapist under KRS Chapter 3 27 or as an\noccupational therapist under KRS Chapter 319A from engaging in that person's\nprofession pursuant to his or her education and training;\n(3) A person licensed as an athletic trainer under KRS Chapter 311 from engaging in\nthat person's profession pursuant to his or her education and training;\n(4) A person licensed as a physician under KRS Chapter 311 from engaging in that\nperson's profession pursuant to his or her education and training;\n(5) A person licensed as a chiropractor under KRS Chapter 312  from engaging in that\nperson's profession pursuant to his or her education and training;\n(6) A person licensed as a pharmacist under KRS Chapter 315 from engaging in that\nperson's profession pursuant to his or her education and training;\n(7) A person certified as a therapeutic shoe fitter by a nationally recognized board from\nengaging in that person's profession pursuant to his or her education and training\nand within that person's scope of practice as defined by the certifying board;\n(8) Individuals actin g under the supervision and control of a licensed pharmacist or\npharmacy from measuring, fitting, or adjusting any noncustom fabricated and fitted\ndevice including but not limited to over -the-counter devices, so long as such\nindividual does not create a ca st, mold, or scan of a part of the human body for the\npurpose of constructing a medical device to treat a patient's medical condition, and\nso long as such individual meets one (1) of the following criteria for the device:\n(a) Documented training from a man ufacturer or training from a licensed or\ncertified orthotist, prosthetist, or pedorthist;\n(b) Certification or registration as a fitter of orthotic, prosthetic, or pedorthic\ndevices from a nationally recognized board or association such as the Board of\nCertification/Accreditation, International (BOC), the National Community\nPharmacists Association (NCPA), or the American Board for Certification in\nOrthotics, Prosthetics and Pedorthics, Inc. (ABC); or\n(c) Direct supervision by a trained and experienced, or c ertified, or registered,\nfitter of orthotic, prosthetic, or pedorthic devices; or\n(9) Individuals acting under the supervision and control of a licensed pharmacist or\npharmacy from measuring, fitting, or adjusting any noncustom fabricated and fitted\npedorthic devices including but not limited to diabetic shoes, so long as the\nindividual meets the criteria of either subsection (8)(a) or (8)(b) of this section, and\nso long as the individual does not create a cast, mold, or scan of a part of the human\nbody for the purpose of constructing a medical device to treat a patient's medical\nproblem.","path":["KRS Chapter 319B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41872","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"5afcd3d5a331eff97e70366c34bbfb056983b3c54f6915e9727faf4a97565ea7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319b.080","next":"us-ky/krs-319b.100"},"notice":"GroundRules: Original legal text.
