{"data":{"id":"us-ky/krs-319b.140","jurisdiction":"us-ky","citation":"KRS 319B.140","heading":"Penalty for unprofessional conduct.","body":"(1) The board may deny or refuse to renew a license, may suspend or revoke a license,\nor may impose probationary conditions where the licensee or applicant for licensure\nhas engaged in unprofessional conduct which has endangered or is likely to\nendanger the he alth, welfare, or safety of the public. Unprofessional conduct shall\ninclude:\n(a) Obtaining a license by means of fraud, misrepresentation, or concealment of\nmaterial facts;\n(b) Unprofessional conduct as defined by administrative regulations promulgated\nby the board or violation of the code of ethics promulgated by the board\nthrough administrative regulations;\n(c) Being convicted of a felony in any court if the act or acts for which the\napplicant or licensee was convicted are found by the board to have a di rect\nbearing on whether he or she should be entrusted to serve the public in the\ncapacity of the licensed profession, if in accordance with KRS Chapter 335B;\n(d) Violating any lawful order or administrative regulation rendered or\npromulgated by the board;\n(e) Violating any provision of this chapter;\n(f) Violating KRS 304.39-215; or\n(g) Engaging in conduct that is subject to the penalties under KRS 304.99 -060(4)\nor (5).\n(2) A denial, refusal to renew, suspension, revocation, or imposition of probationary\nconditions upon an applicant or licensee may be ordered by the board in a decision\nmade after an administrative hearing conducted in accordance with KRS Chapter\n13B and administrative regulations promulgated by the board. The board may\naccept or reject an application for reinstatement following an administrative hearing\nconducted in accordance with KRS Chapter 13B.\n(3) The surrender of a license shall not serve to deprive the board of jurisdiction to\nproceed with disciplinary actions under this chapter.","path":["KRS Chapter 319B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49066","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:15Z","sha256":"abac0c8da299c9f366034e26d681b0c542bbc26d02651f6ea6e3b0a763f838b3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-319b.130","next":"us-ky/krs-319b.150"},"notice":"GroundRules: Original legal text.
